Now, as for how to fix this error: we CAN ask and we CAN engage in diplomatic activity to pressure ES to return the man. They’ll comply, they have no reason not to. Can’t guarantee it however, which is why the process the administration followed is unconstitutional if not criminal.

Here is some very easy math for those of you in the last row: Since the vast majority of the Venezuelans sent to CECOT had no criminal records and zero links to gangs, they would never be tried, much less convicted and put in a US jail, whatever the cost.

1) She ordered the government to request that El Salvador return this guys; and,

2) She's a Trump appointee.

Not sure how you aren’t following. PP had said we have jurisdiction in ES on this issue because of payments, but then it was pointed out that the contract is for a totally different group of people (Venezuelans) so actually no, we don’t. Stop listening to biased NPR. This man was seen by multiple courts and had plenty of due diligence. The issue is simply an error in destination, not that he had authorization to stay in the US.

Those hearings had nothing to do with his deportation pursuant to the Alien Enemy Act. since the administration chose to use that, they chose the rules. And the rules say he needed to have provided, minimum, notice and opportunity. The courts all agree. Up to and including the Supreme Court. And the administration agrees.

With respect to what the agreement with El Salvador covers, we do not know. No one has seen the agreement and all we have are vague statements from an administration who refuses to comply with discovery orders and generally is telling everyone and their uncle to FO.

Please stop spreading misinformation. Garcia was not deported under the Alien Enemies Act. He was removed under title 8 of the immigration and nationality act.
