PP is correct. I just want to add for those that keep saying Garcia already had 2 hearings and therefore had due process--and further, that he lost both. The MOST RECENT hearing was in October 2019, when Immigration Judge David M. Jones granted him "withholding of removal" status. This decision legally barred his deportation to El Salvador due to a "clear probability of future persecution" he would face there. The U.S. government did not appeal this ruling, making it final and superseding any prior administrative findings, including earlier bond determinations based on contested gang affiliation allegations. Get it? The October 19 ruling where he was granted "withhold of removal" (to El Salvador, specifically) supersedes the earlier ones MAGA keeps talking about and is the one the SC was responding to in their decision, not the earlier ones. |

Regardless of whether Garcia is a good or bad person, regardless of earlier court rulings, and regardless of whether you find him to be a sympathetic figure or not (most don't, including me), what you can't seem to grasp is that the most RECENT or LAST time he appeared before a judge was in October 2019 where the judge gave him "withholding of removal" status. Because he was sent to El Salvador despite the withholding of removal, on April 10, 2025, the U.S. Supreme Court unanimously ruled that the Trump administration must "facilitate" his release because he was unlawfully deported to El Salvador despite a prior court order prohibiting his removal. It's that simple. |
Neither of the PP’s are correct. He had a hearing and was granted a “withholding of removal”. That was the last hearing he had! Those words mean that there was a court order FORBIDDING the government from sending him to El Salvador. Let’s stop debating the eff up, as it’s already been admitted but the administration. You can argue that it’s out of our hands now if you want, but that makes you an evil SOB. |
