Trump is afraid to testify. He doesn't want to add perjury to his list of offense, and if he tells the truth, he's sunk.

So basically, the jury will have no defense to weigh. This isn't a criminal case where the bar is beyond reasonable doubt. Testimony as evidence will have been presented with nothing to dispute it.

The bar is preponderance of the evidence. Presumably Trump's defense will rely on cross-examination statements and maybe documents that contradict this or that. They'll argue that the witnesses and documents Carroll presented do not rise to the level of preponderance.

But, if I'm a juror, it would be hard to notice the defendant not stepping up to say, "I never raped this woman."

Trump announced that he was flying back to testify in rape trial. He will get back just as case as bern given to jury and then he'll rant and rave about the crooked judge not giving him an opportunity to testify! I hope she gets a billion dollar judgment.
