A White House official said that President Trump would not comply with a Tuesday deadline set by House Democrats to release his tax returns to Congress, setting up what was expected to be an extended legal clash between two branches of government.

Asked about the April 23 deadline in an interview on Fox News, Hogan Gidley, a White House spokesman, signaled that Mr. Trump was girding for a protracted fight over his returns. Earlier this month, Richard E. Neal, the Democratic chairman of the House Ways and Means Committee, formally requested from the Internal Revenue Service six years’ worth of the president’s personal and business tax returns, but so far the Treasury Department has said it needs more time to respond.

“As I understand it, the president is pretty clear, once he’s out of audit, he’ll think about doing it, but he is not inclined to do so at this time,” Mr. Gidley said.

But releasing the tax returns is not exactly Mr. Trump’s choice. Mr. Neal is employing a provision of the tax code to request the returns, which he said his committee needs in order to evaluate the policy of automatic audits of presidential tax returns.




Contempt of Congress? I am sure Trump and others in his administration are terrified ............. just like Eric Holder was when he was found to be in contempt of Congress.

Mnuchin continues to stall.

The Treasury Department on Tuesday missed a second deadline from House Democrats to provide President Trump’s tax returns.


Treasury Secretary Steven Mnuchin said that the department can't act on the request "unless and until it is determined to be consistent with law." He said that he expects Treasury to provide the House Ways and Means Committee with a final decision by May 6.

Legal experts say it’s Treasury Secretary Steven Mnuchin who needs to be careful. Ten days ago, Neal said if the IRS didn’t hand over six years of Trump’s returns by then it “will be interpreted as a denial of my request.”

Assuming noncompliance continues to be the administration’s tack, the chairman of the tax-writing panel has three options, legal experts say. He could issue a subpoena for the information, file a lawsuit in federal court asserting his authority to get the returns or take the matter to the full House and seek to hold Mnuchin, IRS Commissioner Charles P. Rettig or both in contempt of Congress.

At an event held by the left-leaning advocacy group Tax March last week, Democratic California Rep. Judy Chu, who sits on Ways and Means, said Neal “would likely issue a subpoena for the returns” and if the administration doesn’t comply “a legal battle would begin to defend Congress’ investigative authority,” according to a transcript supplied by Tax March.

“If Secretary Mnuchin fails to comply with this deadline, Chairman Neal has no choice but to subpoena the Treasury Department and force the IRS to comply with this request,” Tax March spokesman Ryan Thomas said Tuesday. “If Secretary Mnuchin or other Trump administration officials continue to stymie the process, House Democrats should look into holding them in contempt of Congress.”

Failure to comply with a subpoena also could lead to Mnuchin being held in contempt of Congress, along with a court order of daily fines or even jail until he does comply, experts say.

“To me the person who’s most vulnerable to this is Mnuchin because, of course, the statute directs Mnuchin to do something, so if he doesn’t comply then he’s the one in violation,” said George K. Yin, a professor at the University of Virginia School of Law and former chief of staff of the Joint Committee on Taxation.

“Mnuchin could well be on the line here if [Democrats] seek to enforce” the request for Trump’s tax returns, said William Alden McDaniel Jr., an attorney with Ballard Spahr LLP who has represented officials in both Republican and Democratic administrations targeted in congressional investigations.

Trump would be the first president since Richard M. Nixon not to release his tax returns.

Well, a federal Judge found that there was no basis for the House contempt motion, which she called "entirely unnecessary" so that would explain why he didn't face any consequences. You need to read more.

A federal judge has declined a House committee's bid to have Attorney General Eric Holder held in contempt of court — and perhaps even jailed — for failing to turn over documents related to the Justice Department' s response to Operation Fast and Furious.

However, in a ruling Monday, U.S. District Court Judge Amy Berman Jackson also denied Holder's request for an indefinite stay of her prior order that the attorney general must turn over any "non-privileged" documents the House Oversight and Government Reform Committee subpoenaed as part of an investigation into the botched gunrunning investigation. The judge previously ruled that Holder must give the panel any documents that are not both predecisional and deliberative in nature.

Jackson called the House contempt motion "entirely unnecessary" and said it was evident that she was considering the government's motion to lift her prior order. "Under those circumstances, the Court finds no basis to hold defendant in contempt," she wrote.

Berman was appointed by Obama ...... surprise, surprise.

And another federal judge more kindly disposed to the administration will find the same about these contempt citations. And it will end up being heard by the Supreme court by which time Trump will either be out of office or reelected.
