Complicated Grief and my late friend’s husband

You can make a will or trust, but as a married couple you have joint assets and debt. In my state debt collectors cannot take your pension or life insurance policies. My ex put a pension we had while married in his will. The pension plan gave it to me as beneficiary because that superseded the will. You can put anything in a will or trust, but it has to be legal.

Unless you have separate assets you kept separate before marriage I would get life insurance policies payable to your children. They bypass everything and will go directly to them. Keep your spouse completely out of it to be safe.

If the wife wanted to, she could have started a trust for her son before her death. She did not.

Sure the wife can start a trust for the son but only if she has separate assets. Can't trust away your husband's marital property. Not sure people understand that one. The trust is typically done by husband and wife. Definitely should have made sure her son was protected, but if he's in college and is doing well I'm sure he'll be just fine.
