If you think Republicans are going to kill the TJ lottery....

A lottery is race-neutral. The fact that it is replacing a process that was NOT race-neutral doesn't have any bearing on whether or not the lottery itself is legal.

If Asians want the school to continue to be 75% Asian, which based on these boards seems like their biggest priority, then all they have to do is send enough qualified applicants to the lottery so that the pool is 75% Asian in each region.

But I'm not here for folks who will claim disparate impact once applications from all other demos spike because they're hoping that it won't be filled with racists who think they're smarter than everyone else.

Think I'm exaggerating? Go check out LITERALLY ANY TJ student Facebook groups.

We shall see. But the odds of the proposal being struck improved dramatically in the past few days.

How, precisely? Nothing in the groundwork has changed. People on this board are talking about the Loudoun letter, but that will have essentially zero impact.

they think a conservative judiciary is going to look at lawmaker intent, because protecting TJ is somehow the cause that will get them to abandon textualism

The conservative district court judges and conservative court of appeals judges will likely become “ bolder “ knowing their decisions will be upheld by the Supreme Court if appealed.

is TJ a conservative cause anywhere other than in the minds of its defenders?

They don’t care about TJ, they are just itching to strike down racial preferences.

~ Secretly Thrilled TJ Parent

But the system became "gamed" because originally some low income student's parents decided education was the most important thing for them and did what it took and paid what it cost. And today, maybe those Asian families are no longer low income but that too should is a story in itself.

There was and is absolutely nothing stopping Black and Hispanic families from doing the same. And just like Asian families, they might not have had super success at first but they stuck with it and now their kids dominate.

Not once in the past five years, have I seen the Black or Hispanic community do anything to create test prep programs and push their kids to attend existing ones. Yes, it takes money, so yes, you have to redirect some of your budget to it and take away from other areas. This is the middle class way. So if those families are trying to get out of the low income trap they should understand and start embracing middle class ways.

It's so funny how Asians want to cry racial prejudice while being racist themselves. Pp mentioned lower income. You immediately interpreted that as black/hispanic. There are many reasons why many blacks dont prep for TJ. Just as there are many reasons many asians dont prep for the NFL. It has a lot to do with representation, societal expectations, social pressure, racial prejudice, discrimination, generational/inherited mindset, access, etc. Dont be so obtuse.

Every Asian in this nation came by choice in search of a better life. Viewing America as a land of opportunity, Asians come with a certain mindset. Just about every African American (not african immigrant) came here on a slave ship. How can you think their ancestor's views of America would be the same? After over a century of suppression, how can you think their mindet would be the same? If you want others to stand up for you, dont start by tearing down others.

so out of all the cases they could choose, they'll use a race bling lottery (the same kind of lottery that is the basis for charter schools necessary for school choice that they do care about)? seems logical

Where exactly are any "racial preferences" in FCPS's plan? Unless you get a substantial difference in racial breakdown between the applicant pool and the lottery pool in the new system, there won't be anything to cry about. The new policy is 100% race-neutral.

Lottery systems are an absolute staple at charter schools, many of whom rank extremely highly in US News and World Report rankings.

Republicans are generally strongly in favor of charter schools because they draw away from public schools and offer "school choice" to their constituents.

I know for sure the democrats won't kill it. They are the author of this proposal.

TJ is not a charter school. It is a school for gifted students.

Yep, but it is a Governor's school. It is a public school. And so, by classification, are charters - they receive government funding just like magnet schools do.

A court cannot strike down TJ's merit lottery system without creating MAJOR problems for school choice across the country.

You are missing the cause and effect. R doesn't like public schools hence R likes charter school. It has nothing to do with the love of lottery. On the other hand, democrats created this lottery proposal.

This proposal will be strike down in my opinion. I am not a lawyer but learned something here called "disparate effect". Fairfax democrats wants to address racial makeup of TJ. So the proposal has everything to do with race. And this proposal will dramatically cut down Asians' representation from 70% to 30% while the whites' representation doubles.

So you learned a term, but clearly have no idea how it is actually applied?

Except that isn’t how common law works in the US- invalidate one lottery and any similar lottery is now in question

If there is a racial component. Besides, district court decision is only binding on a given state or a district within a state and court of appeals decision is binding only for states unless Supreme Court agrees to hear that case and rules.

I just explained my understanding of it. You offered nothing. This proposal is about race. It is not race neutral. The existing application process which is holistic is actually race neutral.

You did a great job explaining your understanding. More than I can say for posters keep repeating the same thing that the proposal is race neutral when they know it is not. Just ask Brabrand and his supporting documents. He dug his own grave. Too funny.
