The courts will ultimately decide the definition of sex, and it will have to be consistent for Title I and IX, probably no one will be happy. Not the OP. But I have studied the facts, which are not addressed in your link. The unintended consequences of this ill thought out policy will certainly be a challenge. DOE and one lower level court in Texas have advocated that the term "discrimination based on sex" as described in Title I must not be strictly interpreted based on biological sex. That an individuals sex must be respected based on whichever sex they choose to be and that it is unreasonable to ask for any legal, medical, or other documentation. An individuals sex is simply what the individual claims it to be. If this precedent survives, the same definition must apply to Title IX as well. It will be a mess. |

The organization of this backlash is from a few very conservative congregations in the area and one outside hate group. Andrea Lafferty of the Traditional Values Coalition was present and visibly the main organizer when I attended two school board meetings where this topic was discussed and public commentary was given. I have been to many school board meetings over the years for various reasons and the first of these meeting last year was the most tension filled and hated filled I have ever attended. It was downright scary. |
