Aren’t straw purchases a federal felony that can net somebody ten years in prison and a quarter million dollar fine?


Straw buying is very difficult to investigate and prosecute. You need to establish intent that the seller willfully knew he was selling firearm(s) to someone who shouldn’t have that firearm or who will go on to resell it illegally.

ATF has also been decimated by GOP budget cuts.


Unsurprisingly, you focus on the wrong end of the transaction. Straw purchasers seldom are one and done, and nice they’ve got them on the hook, the investigators follow the chain upward as in any other investigation.

You’re also missing the point. The activity getting blamed for criminals having guns is already a serious crime; for most criminals, mere possession of a firearm is a serious crime; all that in addition to whatever serious crime they misused a firearm in connection with.

If only we had better mechanisms for detecting and investigating straw purchases. There's no central database or coherent mechanism to track whether someone's bought 200 9mm pistols in the last 12 months, and that's absolutely insane. And there's an entire underground industry that takes advantage of this, to feed criminals. Along with a dozen plus other serious problems and weaknesses that gunrunners and criminals take advantage of.

How about worrying as much about point of use as we do point of sale? As the Post article made clear, criminals with gun offenses are routinely not charged.

All that said, if local criminals must turn to farther away red states for 50% or more of their guns, that shows that local gun laws DO work to impede straw purchases to some extent.

They'd have a jurisdiction issue but couldn't they still do some undercover work and investigations and then bring in ATF for a federal raid?

I have personally witnessed on several different occasions a panel type delivery truck with a large “NRA” logo on the side pull up to youths walking home from Roosevelt HS and sell them guns. I’ve also this happen at the Anacostia metro station and across the road at the Barry Farm basketball courts. The truck is always being driven by a pair of white men wearing business casual clothing and sunglasses. I would testify to this in court if I could.

What keeps going right past YOU is the FACT that if Republican voters passed sensible, responsible gun laws, there would be a whole lot less gun crime - not just in DC but EVERYWHERE IN THE US because it also happens in red states too - and when you look at the per-capita rates some of the reddest counties are even worse than DC for gun deaths. Is it fun for you to be embarrassed and proven wrong? Because, you just were.
