Why would she feel the need to say that? Wouldn't you assume that they would be doing things legally/by the book?

And, think about this......Flynn would have discovered what they were doing. Others with less experience might not. The unmasking is just part of it. They were spying on the Trump campaign. Why do you think they spied on Carter Page--who had been a CIA asset for years? It was an excuse.
