| The landscaper didn't 'break' the fence post - it was rotted and may have already been broken and just not fallen over. OP never said how old the fence was. If it was old and rotted, no one owes OP a brand new fence, not even the landscaper. OP is the neighbor from hell. |
There is a lot of misunderstanding about surveys here. Someone said surveys done when you buy a house aren't real surveys - that's incorrect. A survey isn't a piece of paper. People are most likely confusing a survey with the the plat they were given when they bought a home. The plat shows measurements and dimensions of a property but is not a valid document to determine property lines. Most plats even state that on the document. The surveyors left markers at least at the corners and there should be metal pins that can be found with a metal detector. One can also pay to have additional pins put in along their property line. Op's neighbor could show her the pins from his survey. Op should get a new survey of that side of her property and have additional pins put in. She will not prevail in any legal situation without better proof that the property is hers. |
| Also I was able to get a survey done last year for less than $500. Op has much more land but she can find a surveyor to just do one side or part of one side. |

Op's comment that she "gave" her survey to her fence installers shows she doesn't understand surveys. It sounds like she handed them a copy of her plat and if they measured from that it would not be surprising if her fence was not on her property.
If she had a survey done, the fence installers would use the markers in the yard to install the fence. |
