Wow! At least you don't have to think about this anymore. We are Jewish, and some years when our babies were small, our nanny still worked the holiday so we could go to adult services. As with many DC area residents, we don't have any family in town, so it isn't like we were having all-day family holiday get-togethers. |

Yes, nannies can get unemployment. That is just a risk OP will have to take. I'd pay an extra percentage point on my unemployment insurance for awhile to get rid of this lady, too.
To qualify, she will have to prove that she's actively searching for a new job. And you're not allowed to be super picky -- if you're offered something reasonable, you're supposed to take it. So, she will either get a new job, or she'll be too busy with her classes and living her life to fulfill the requirements of UI, and OP might not take much of a hit anyway. |
Do you realize how many parents pay cash under the table? Yes, in this area. How exactly does that work when their laid off nanny files for her weekly unemployment check. Can't be good for the employer, can it? |

Since I've always paid legally, I have no idea, nor do I care that much. I suspect, that as with many things, the punishment is never as bad as people hope it would be. Likely just back taxes + penalties. |

Yes. My guess is no one has ever served jail time for this. Maybe if you ran a company with lots of employees, you might get some kind of sentence. For a couple with a nanny, it would never happen. |

My nanny friend, who was let go from her position, received unemployment for a couple of weeks until she found a position. She was paid half under the table and the other half through a payroll system. She only claimed the legal payment to receive unemployment. |

I assume if OP said the gross weekly and net weekly there are tax withholdings from both parties. Regardless, it would be very difficult to give even a semi-positive reference if this is how unprofessional and belligerent the nanny is. And I would definitely not provide a severance if she is acting how she is. |
Oh wise nanny, pls do share what happens when you go to file unemployment with no proof of an actual job. You aren’t paying taxes, which means you didn’t fill out forms. |
