You can't sue someone just because you want to. She tripped taking out the trash. Something they didn't ask her to do and through no negligence on their part. You can only sue if they were negligent in some way, ie snow they didn't clear or broken pavement. OP was just clumsy and tripped.

OP, I'm really sorry you were let go. That really sucks but please ignore the stupid posters like the one above who would have you waste your money on a lawyer and court fees for a case you can't possibly win.

Nannies are at will employess, you can be fired for any reason or no reason at all. You can also always be fired for not being able to fulfill the duties required in your job, which it sounds like she was not able to do because she can't drive.

I had a previous MB fired when she was put on bedrest with twins. When a company is too small for FMLA (just like private employers) to be in effect, there is really no protection for the worker in situations like these.

Stinks OP, but not illegal.

Op here, I totally realize that she's within her right to let me go, and it's completely legal. I never had any intentions of calling a lawyer. Apparently this was their plan all along and I fell just days before they were going to give me notice so they waited longer. Apparently the claims adjuster advised them to wait because to much stress would delay healing.

It sucks because I go back to the doctor in 2.5 weeks and hopefully get the go ahead to remove the boot and resume normal activities. That gives me 2.5 weeks to find a job otherwise I can't pay my rent or car payment next month. Their timing just really stinks.

I'm really sorry OP. You should hopefully be able to find something in 2.5 weeks even if it's temporary so you can pay your rent while you look for something more long term.
