| Happy for you OP, feel better! |
| I suspected she was making phone calls and didn't want to say anything that might be construed as a promise to pay until she found out her insurance coverage. |
| I always wondered how this worked. During the winter, my employers failed to shovel their stairway before I arrived pretty much every time it snowed, and never salted it for ice. If I break my ankle on their snowy/icy steps, would that be covered by worker's comp? |
| I know she's upset because she needs to find someone to care for her child and there's no one around here that she knows that could. Legally she can't fire me for best Can she? A friend of mine said to get a lawyer because when she filed for workers comp She was fired in the end. I don't think that they would do that, but you never know. |

Here is some good information. It sounds like you can probably at least get a free consultation from a lawyer. |
| Unfortunately I am still waiting for the doctor to give me the go ahead from the WC to get seen. Which now wont be til monday or tuesday. MB seems upset that I can't work, I thought maybe once I got a cast on, Id be okay, but ive been reading that its possible I have to stay off of it for 6-8 weeks and not drive 9-12 weeks. Im hoping this isnt the case, but I am scared of getting fired! |
|
OP, try not to worry too much and your job, yet. I had a bad compound break and while I did have to take off a week for surgery and recovery, I did not have to stay off it for 6-8 weeks. I will say that I couldn't drive for 8 weeks, but hopefully your NF will work with you to accommodate that.
Take care. Worker's comp exists for just this kind of thing and I'm sure your NF knows that. If they don't, then you don't want to work for them. |
| The good news is that I don't need surgery, and I can walk on it. However, I can't drive for four weeks. Which means I have no way to get to work, and no way to take their son to school. I am also on crutches. Not to mention their house has four floors with the main level being on the second floor and the child's bedroom being on the fourth floor. The doctor suggested I do not work. But I will be calling my claims adjuster tomorrow to see what he says. |
| ANd the bad news is that today, while I am still on leave, MB called and informed me that they are letting me go. Pretty Crummy. |
What Breedlove have to do with this? |
| Breedlove didnt have anything to do with it. My employers filed a claim with their WC ins. But now I am on leave until I go back to the doctors on may 15. But MB called me a little while ago to inform that they are putting their son into full-time school starting may 22. SO basically Ive been laid off. WC better atleast pay through my Doctors appointment. |
Sorry to hear that OP. Are they at least offering you severance? Is this legal? If not, I'd take them for everything they are worth. |
| OP here, I would have no legal ground, as they stated they are letting me go so they can send their son to full time preschool and that they were going to tell me, and then I had my accident. she mentioned no severance on the phone, but I am assuming workers comp would have to pay me until the doctor released me back to work and at that point, I would be on my own and need to file unemployment. |
Huh? Take them for everything they got? She hasn't worked floor a week and you are an at will employee. |
She hurt herself at their freaking house, trying to help them out. Hell yes, take them for everything they're worth. |
