Also, this is not an employer issue; you should have post d in the general forum. |
You are naive. That's not even legal. You can sue them for OT wages if they didn't pay you OT when you worked over 40 hours a week. What state is this? |
If I give my notice and I stay for a month I could be set for at least 3 months of unemployment. If they say do not come back I'll be set for 6 weeks. I literally came home tonight in complete hives because I'm so stressed and so miserable. |
1. Do you understand that they gave you an illegal agreement to sign? 2. Do you understand your job is "at will"? 3. You obviously didn't have a lawyer review that "contract" for you. Get a new job and quit. Enough is enough already, yes? |
A lawyer is one that wrote the contract. Maybe the way I explain it was confusing about guaranteed hours. No where did I say I wasn't being paid for hours I was working. I stated that I was guaranteed average of 40 a week. If I work 55 hours I am paid for 55 hours. |
That's illegal, for the third time. When you work over 40 hours in any one week, you get time and a half. They know you aren't too bright. Sue them for God's sake. |
Wow the last commenter is a jerk!! She clearly stressed about this job and upset. Do you think saying she not bright is right thing to do? Jesus |
How many times do you repeat the same thing with a smile? |
She. Did. Not. Say. That. She. Wasn't. Paid. Overtime. When. Working. Over. 40. Hours. Don't be an ass! Nowhere did she say she wasn't paid overtime. YOU maybe are not so bright. She said that she was guaranteed a minimum amount of hours per month, averaging 40 hours per week. She did not say that she is paid for 40 when working 55. I can't imagine that you behave this way in real life. A mirror would serve you well. OP, you have two choices. 1) Give notice now and start looking for a job. 2) Find a job before you give notice and give them as much notice as possible, which will certainly not be a month as no one needing a nanny will be able to wait that long. Personally, I'd go with option #2, BUT since you are coming home with hives, you may need to go with option #1. You have to lookout for yourself first and foremost, not someone else and their family. Life throws you curveballs, they'll figure out how to handle it. You are not responsible for their children or their life, only your own. Also, nannies are at will employees, contracts are nearly meaningless, especially from a legal standpoint. Finally, is the one month notice mutual or only on your end? That makes a big statement if you are the only one obligated to give that much notice. |
OP was not paid OT when she worked OT. She said she had to average 40 hours per week, on a monthly basis. |
Btw, OT pay means time and a half. |
She said that was her guaranteed MINIMUM. FFS! OP, are you paid overtime for hours worked over 40? I am asking bc PP is making assumptions and has terrible reading comprehension. |
Oh, I'm still in middle school so that helps me greatly. Thanks for clearing that up. |

This poor nanny is screwed if she chooses not to sue these abusive parents. |
