| We live in a row house in DC. New neighbors renting 2 doors down (4 adults) are smoking pot on front porch and back porch throughout day & evening. They have 2 young kids so I understand why they’re smoking outside. No issue with pot smoking in principle except we can no longer keep windows open and our kids can smell it when playing outside. One of our other neighbors asked if they could smoke elsewhere, but nothing’s changed. Was an AirBNB but when COVID hit, owner converted to long-term rental. Since pot smoking is legal in DC, don’t think they’re breaking their lease. WWYD? |

Do you know the owners? I would tell them. Smoking could be against their lease, even outside. Maybe if you tell the owners, the owners would be willing to put that in the lease for the next occupants, whenever that might be.
What kind of parents smoke pot day and night? I’d be tempted to call cps. |

| OP I understand it is really smelly. No consolation but many people are truly using marijuana for medicinal purposes as well as for the recreational high. For chronic pain sufferers it provides some relief as an alternative to more addictive drugs like narcotics. And people are so generally stressed out these days. |

| Nothing. It's the same in our neighborhood. You get used to it. Our kids don't care. They know it's pot and that it's just for grownups, like alcohol. It's harmless. |

| It's not legal to smoke outside, inside only, even if it's your home. My neighbors (who own) do this all day, every day. I mean starting at 9am throughout the evening. Can't open our windows in back, only in the front. I guess I'm thankful that they're at least predictable so we can keep our front windows open. It does severely diminish enjoyment of our back yard so I have sympathy. You can complain to the landlord, who can serve them a notice to correct or vacate because they're engaging in illegal activity, regardless of whether smoking inside is banned by the lease. The landlord won't do this, especially not if they're paying rent, they'd be insane. You can also ask that the landlord add this to their next lease. But there's basically nothing else you can do. |

Agreed. Smoking in public and outside is technically illegal. Though DC and the mayor, and the council have decided NOT to enforce the laws and turn a blind eye. Had I known that, I NEVER would have voted for legalization. Now, on the ballot is Initiative 81, for legalization of hallucinogenics. Thought they way the ballot is written, it seems like a positive thing. After witnessing a tripping man having sex with our retaining wall, and the ever present drugs of all kind in DC, we are voting against Initiative 81. I urge everyone to do the same.
As for your neighbors, you are legally able to enjoy your property. If the neighbors are doing something that prevents your from enjoying your property, then you can force them to stop. Sending a letter to landlord is a good first step. Talking to them is a good second step. Problem is that most people are completely clueless about the laws in DC, as can be seen by some of the responses in this thread. People think that smoking in public is permitted but it is not. There needs to be a movement to push back again the drug users as their lobby and misinformation has gotten so strong that you can't say anything against pot before getting attacked. This is not really the environment we want to raise our children. The Mayor and Council are eyeing the future tax revues of the legalization of drugs. The rest of us can just move out if we don't want to smell the stench all day and night. |
