I said "could" be considered obstruction. Depends on the circumstances. But if the feds are conducting a legitimate investigation, they can request certain records for "investigative purposes." They generally need a subpoena or warrant, but not always. They could ask for your cell phone records, for example, thinking that you are distributing fentanyl across state lines. And want to see the numbers you call and cell towers you are pinging off of. And so on. If the cell phone company notifies you of that, you are going to be able to alter your behavior so that it's less likely you get caught. Same with driver's records (and addresses!). The problem is, New York's law provided a really easy way to track down undocumented immigrants. ![]() |

Everyone competent at DOJ has been fired or resigned. Turns out you can fudge facts in federal court and remain a lawyer in good standing. Lawyers work hard for their licenses. They tend to draw the time at things that will get them sanctioned and disbarred. |
