I actually think it’s helping to move this thread along so we can get to the point already.

Are you below poverty line OP? If you are there are resources to support with legal advice and sometimes representation in NoVa. What state are you in?

If you can’t afford full representation, at least have a consult and pay for one of those and maybe as needed. They can give you specific risks of your situation, tell you an approach to take, and write letters on your behalf.

Listen. You need a lawyer. Your ex is suing you for full custody of your child. If he has a lawyer and you do not, the chances of you losing custody of your child are a lot higher. He is serious. He thinks that your child would be better off with him full time, and he has been gradually making a case against you. You getting a boyfriend is probably the icing on the cake for him. Were I in your situation, I would call the Women's Center and see what recommendations they have for you. You need to take this a lot more seriously than you have been. It's not about him liking court. It's that he thinks that your child would be better in his care than yours and he is willing to go to court to prove that. What are you willing to do to prove him wrong?

+1. Particularly since custody has already been established he has the burden of proving it should be modified so this should be something you can handle yourself WITH guidance from a lawyer. Honestly, just prepare a few simple interrogatories that request he disclose each point he intends to argue that supports a modification of the custody order. Take that to the lawyer and they can tell you what arguments/information to present and you should be able to represent yourself.
