"Adult Swim" is a Violation of the Federal Fair Housing Act- discriminates against families???

An attorney in Gaithersburg is alleging that "adult swim" time at HOA/COA run pools is a violation of the Fair Housing Act. He claims adult only swim time discriminates against families because it means "certain members of the family can’t use the pool when other individuals can." So his HOA pool is renaming that break time to "lap swim time".

I hate adult swim and don’t see the point. It’s 15 minutes of every hour where the pool sits empty and the kids beg to go to the snack bar.

We belong to a private pool. For some reason I thought it was a legal requirement, but we are in MD.

It’s crazy to get an attorney involved in this but we also think it’s stupid. I’ve heard the reasons like lifeguard and bathroom breaks. In reality the lifeguard’s young friends use that time to horse around in the pool while the lifeguards laugh with them. No adults actually swim. It’s one of the many reasons we cancelled our pool membership. My kids were not interested in swim team and getting out once an hour to watch that was annoying.

I think it’s also to clear the pool so they can see if someone is at the bottom. Remember that lady a few years ago in NJ or wherever who was at the bottom of the pool for two days before they found her? That’s why.

It's also a safety issue for kids. Taking periodic breaks keeps them from getting too worn out and becoming a greater drowning risk, and a kid who is too tired is more likely to realize it when they're just sitting on the pool deck rather than splashing in the pool.

It is also easier to schedule the day. We leave at the next adult swim, etc.

Adult swim was not a thing in the pool where I grew up, and yet somehow people figured this stuff out.

At my pool this is when guards change their spots/start or end a shift. If you constantly have kids in the pool this makes it harder.

How on earth is this family discrimination? If anything, it “discriminates” against children under 16; last time I checked, this is not a protected class. If anything, it would be rational basis review, which this rule would easily meet (ensuring kids get rest breaks to prevent drowning).

We don’t have this at our pool but this weekend for the first time ever since I’ve lived here (6 yrs) we had a 30-minute lifeguard break. His girlfriend showed up right before and they swam in the pool alone while everyone sat and watched. Of course the 30-minute break turned to 45 and then a dad got sick of it and cannonballed in. The guard wasn’t happy but the parents were because then all the kids followed.
