Why “sorry liberals”?

If you are an American and a patriot, you too should consider the damage that Alito is doing to SCOTUS. That damage is ultimately worse for the United States than for “liberals”. You too should desire a SCOTUS that is above reproach and the envy of the world. Our rule of law has made us a global force to be reckoned with.

Alito is mocking the country and everything the United States stands for.

If you are an American, shame on you for not loving your country.

LOL the hysteria over the actions of a judge’s wife that even the Post saw as a non story three years ago.

And yet you GOPers have been hysterical over a judge's daughter who doesn't even live with him.

Explain yourselves.

DP. Who/what on earth are you still babbling about? You've already posted about this and it's entirely off-topic. And as usual, you're speaking to everyone as if they themselves are "guilty" of whatever it is you're obsessing over. Stick to the topic of this thread.

Actually, that was an astute point. Many MAGA types think Judge Merchan can’t be impartial because of his daughter’s political connections, but also think it’s ridiculous for anyone to suggest that Justice Alito should recuse himself from January 6th cases because his wife has a bad habit of flying flags that were co-opted by the insurrectionists.

New York law 100.3 e(1)d(iii) states “a judge shall disqualify himself or herself in a proceeding in which the judge’s impartiality might reasonably be questioned, including but not limited to instances where the judge knows that the judge or the judge’s spouse, or a person known by the judge to be within the sixth degree of relationship to either of them, or the spouse of such a person has an interest that could be substantially affected by the proceeding.”

New York State Bar Association Committee on Professional Ethics, Opinion 673 (1995)(“Whether a judge’s impartiality might reasonably be questioned is necessarily a question of fact in each case. Even if the judge believes that he or she can be impartial, the judge should recuse himself or herself if an objective, disinterested observer could reasonably question the judge’s impartiality.”).

There is a significant factual difference between Judge Merchan and Justice Alito. The fact that the Washington Post passed on the story 3+ years ago is indicative that an objective, disinterested observer would not question Justice Alito's impartiality. The "Appeal to Heaven" flag is a legal flag and until recently flew at the San Francisco Civic Center along with the Gasden Flag (Don't Tread on Me).

Ah the significant factual difference in Republicans' eyes is that Alito is a MAGA Republican and Merchan is liberal. Come on, confess - THAT is the difference in your eyes. You think when a Republican does it, there's no problem.

I'm waiting for you to look at the facts. Instead, you skipped right to political affiliation. Political affiliation - in and of itself - is not enough. There are far more facts that call into question Judge Merchan's impartiality (even assuming we can apply NY ethics rules to a Supreme Court Justice, which we can't).

That is objectivity.

You only need to read Alito’s decisions to know he is not capable of being impartial.

And what I hear you are saying is the SCOTUS does not have strict ethics rules. Agreed. They have none.

+1

Either Alito is slow and he misrepresents earlier opinions to which he refers or he has no judicial impartiality and makes up his mind, then twists the previous opinions to suit what he thinks. Neither is good.

But we know from him flying the Christian nationalist flag that he is not faithful to America.

Talk to the San Fran city council which flew that flag for sixty years.

Hello, welcome to the thread. This has been covered. San Francisco no longer flies the flag that Alito (and several other Republicans) proudly fly because it has been co-opted by the Christian nationalist movement, aka, the GOP.

The ability to be retroactively outraged is one of the Left’s real powers, its refined sense of friend/enemy.

The substance doesn’t matter. The history doesn’t matter. Reason doesn’t matter. What a progressive said a week ago doesn’t matter. What matters is tribal loyalty and hatred of the out group right now.

It’s not the what; it’s the who.

History doesn't matter? Not to GOPers who want to look away from actual history. Just look at how they try to water down the teaching of American history to whitewash its worst moments because they don't want to hear anything but rah-rah-we're the best. Actual history, no need to talk about that.

The United States is too big and too divisive. We need to split up into three or four different countries. This experiment did not work.

I really don’t get how some people thinking quoting Russian propaganda to divide us is funny or intelligent commentary.

One effective way to sever a people’s ties to their country’s past is to redefine and replace their nation’s history and symbols.

People are afraid to touch it but this is the same reason Confederate symbols were attacked. Now the left has come for the spirit of ‘76, thinking that it was going to stop with the Confederacy. They are coming for ALL of it.

Marxism has to divorce the target population from their shared heritage in order to create a new societal foundation untethered from the limiting constitutional framework our country was founded on.

It worked extraordinary well until Newt Gingrich and the GOP corruption spiralled.

If only one justice called for their refusal, it would be all that is needed. Maybe Kagan and Jackson.

Trump congratulated Alito f of r not recusing himself!

You are down a rabbit hole of BS. Change your algorithm.

Who would have thought that the Democrats and the liberal press would be in favor of marital patriarchy? I guess the left pretends to be “champions” of women and their right to self-determination - but only if it benefits them.

Yep.
He is expected to "control" his wife as if she has no agency.
That is the mind of the modern liberal.

You’re both so simple minded. It’s not about her being a woman. It’s about professionalism and optics, two things feds are well aware they need to take seriously. If she were the justice and he were a homemaker who put the flag up, the offense wood be the same. You keep trying to make this sexism is it’s 100% not.

Speaking of simpleminded... the point (which you clearly missed) was to mock liberals who will call out "misogyny, sexism, and patriarchy" whenever it suits their needs. If this was a liberal justice whose wife had done something similarly political and was being called out on it, you'd be invoking all of the above in outrage. In short, we are laughing at you and your constant double standards.

Except that you are completely wrong. Typical RWNJ bullheaded nonsense. You dig in and make up BS to try and defend yourself, but you are just utterly wrong. It is NOT that he needs to talk to her because she is a woman, but because as the spouse of such a public official with such grave responsibilities, she should know better. It would be no different if it were a female judge and the husband was pulling this nonsense.

GOP projection as usual. The RWNJs have these ridiculous double standards for behavior and say everyone else does. Look in the damn mirror.

Agreed. I have said this on other threads. GOP under Gingrich started down this path of demonizing Democrats as enemies instead of colleagues with different opinions. The painted compromise as weakness and defeat instead of the WHOLE PURPOSE OF CONGRESS.

You don't like the country right now? Tell the GOP to learn how to govern again instead of playing at it.

What are you talking about? The Confederate symbols should've never gone up in the first place. For enslaved and now formerly enslaved folks, their sense of liberty and self-determination as embodied by the "Spirit of '76" was thwarted for centuries.
