Yes, half of nothing is nothing. He has no assets (unless he has secreted something away or owned before marriage!) and little current income.

If anything, OP may have to give half her 401k to the ex. If OP can walk away with nothing, that would be a win. Take the win and start over. Imagine how upset op would be if she had to fork over half her 401k AND pay HIM alimony.
