they played all three 911 calls several times. the issue as i understand it is that the cw audio expert enhanced the first call for additional detail and a voice. that enhances version was excluded

Someone else just posted on WS what they thought was said, and I went back and listened to the original audio file on the court's website and now I hear it as clear as day. I won't post here if anyone wants to do their own listening. (FWIW harder for me to make it out in the slowed down version).

If the jury makes that out he is t-o-a-s-t. He might be anyway, of course, but if I was a juror the first thing I'd do is listen to that audio file on repeat.

WTF. Tell us what it is

Please, tell us, I cannot wade through the insanity of websleuths. DCUM is my max.

“ Juliana testified that Christina told her to call 911 right after Joseph was shot and Juliana did. When Brendan realized Juliana was calling 911 he made a cut/stop motion with his hand signaling Juliana to hang up. If this is correct, Christina has not yet been stabbed.

I downloaded the first 911 call to manipulate it better. You can hear a man's voice starting at 8 seconds. It continues and at about 11 seconds it sounds like he says, "I have this" and then you can hear Joseph moaning. The voice sounds just like Brendan Banfield.”

Thank you- I think that’s it or close, and it does sound like BB. Too bad the jury won’t be able to slow it down and lift it. I’d really like to know the grounds for keeping it out. His voice on the tape, whatever it says completely destroys BBs version of events (plenty of other evidence, but this would have been such a slam dunk)

No, no way to tell. If quicker more likely to be guilty. I don’t think NG is likely but could be a hung jury I suppose.

Has anyone ever been to one? How does it work backstage? I mean, I’m certain he’s guilty and idk how there can still be a question about that, but I’m sure they need to check boxes or something?

Would Treasury not require their own internal investigation given he used his Treasury firearm?

If he is considered law enforcement, I’m having trouble understanding why he wasn’t required to provide a statement of events. Especially given he freely admitted to shooting Joe with his Treasury firearm.

(Apologies if this has been addressed already.)

According to the CW, on the stand the other day was the first time he told that whole story. I don’t know if I would say he didn’t give ANY statement though, for example I’m pretty sure on the 911 call and/or bodycam he says stuff like I shot him, he was stabbing my wife. I don’t remember exactly what he said on which one, but he definitely said stuff.

Soon after that he must have lawyered up and given very minimal statements/explanations besides whatever he had already said. He was driving for Uber to make money while Juliana was in jail. I would assume if he did not give any statements (that added up) he would have been on unpaid admin leave pretty quickly. But even if he did still get his salary, imo it would be pretty tight to pay all their bills plus lawyer bills but I guess that’s where Tess comes in. Christine could have had life insurance but what happens with that when there’s such an investigation? I’m not sure.

I think if he had told that story or even half of it on record anywhere before, the CW case would be somewhat different and stronger (so even if he does appeal or has a hung jury here, I think the evidence would be more overwhelming next time because of this statement).

During the testimony the CW basically said he listened to the CW's evidence throughout the whole trial and then crafted his story around it for his testimony.

I wonder then, why make up something like the work meeting? I don't think it was necessary based on the CW's case, was it? The birthday party in NY I assume was real because he and Juliana discussed it on Discord before the murderers.

He was smart about most of the details, so I wonder why he made up a meeting with his manager, when he knew his managers were both out of town.

More inside baseball for ya'll. I assume, but don't know, that TIGTA was very interested the events that caused the discharge of a government firearm that caused death or serious bodily injury(shop language). As far as the TIGTA investigation, It gets a little nuanced legally as any statement he provided would have been likely subject to a Kalkines warning. As far as I understand, his statements covered under Kalkines could not be used in any criminal procedure.

I understand he was on admin leave and terminated from his position with the IRS shortly before he was arrested.

The ghost meeting has.me a little perplexed. there are a hundred reasons that an agent might need to come in early for that would be hard to disprove. My best guess is that BB told this story previously or there is text messages with CB referencing his meeting and he had to stick with that story.

I think he cooked up the morning meeting lie later. He did say the bizarre “I need to call my manager” as he was leaving his home that day with emergency workers, but I don’t see much foundation for it elsewhere.

Yeah he said that he needed to call his manager.. But, in my opinion, this doesn't have anything to do with him missing the ghost meeting. There's a notification process anytime a firearm is discharged outside of training. SA Smith went over some of this during his cross with Carroll.

How far in advance was the meeting with Joe set up?

I have not, but yes, they have to fill out the verdict sheets which can be confusing and they will often ask questions about what they mean. I think that happened in the Karen Read case.

I am lost. Why didn’t the CW do this enhancement on direct? My guess is that it was excluded because it came up on rebuttal and judge was concerned about new evidence comig in.

My guess is that it has something to do with the expert — that maybe the expert testimony didn’t meet the standard for reliability if tje expert wasn’t sufficiently clear or confident or the enhancement technology is too new to be sufficiently reliable/accepted. There was probably a motion in limine to exclude it and the ruling left often a possibility of it coming in on rebuttal depending on what the defendant expert said. That’s just a guess though. I agree it’s somewhat odd they couldn’t get the enhanced version in. Disappointing.

Thanks. Maybe you are right. Are motions in limine in the record and the decision?

At most I think they were messaging around 2 weeks, meeting set up w/in days?

JPM had broken up with BB around Valentines, plan seemed to kick into a higher gear after that?

i’m cautiously optimistic there’s a verdict tomorrow. it would also be a good sign if the jurors send out a request for a set of audiophile headphones.

hopefully the prosecutors enjoyed their weekend. it was likely the first time they’ve rested in months.

I know some people were hopeful for a quick verdict on Friday, but personally I’m glad Brendan has to wait and worry.

I don’t understand how it can take so long, even if they have to fulfill paperwork. I was looking up the forms and apparently is just guilty or not guilty options. Can someone explain what happens in the room with the jury that they would spend hours on it ?
