Yes. California, sort of. I think it depends on how many units are in the building. (Someone renting a one-unit or two-unit townhouse might not have the same legal requirements. But, in a 200 unit complex? Absolutely.) You also have to be at least 20 feet away from a building to smoke. Honestly, if you want to make the Libertarian argument on smoking, go right ahead. But most Libertarians agree that once you start hurting other people, the law should step in. |
