To be clear, I think most of us are not arguing that it is illegal for Alito and his wife to fly a flag upside down or any other manner on his private property, or to burn the said flag, or display a neo-Nazi or Hamas flag for that matter. But we would like Justice Alito to recuse himself from any case that comes before SC that has anything to do with the insurrection or people involved in it. Because the Justice has demonstrated at least the appearance of partisan bias that could affect his ability to adjudicate impartially. Whether that actually happens or not is beside the point. It is the appearance of bias and lack of impartiality that's the problem.
Apart from that, as many have pointed out, this would violate the ethics standards for any public official who needs to demonstrate impartiality, including lower court judges. Unfortunately, noone seems to be empowered to hold SC judges accountable for ethics violations, other than SC itself. Wonder how Roberts will react to this. It must be of some concern to him that the SC is rapidly losing its trust among citizens, which is crucial for the court to retain its status and power, and incidents like this do not help. |
