Can a real lawyer weigh in here. I suspected the judge would do something, but didn’t know what options he had. I assume Trump will pardon if the judge decides to go ahead and sentence. Doesn’t that put some stress on the White House if Trump pardons Flynn? More than just it looking bad. Trump doesn’t care about that. |

Clever. Judge Sullivan is kicking the can down the road. I hope the amicus briefs will take until January 22, 2021.

This isn’t quite my area of specialty, but I think it’s questionable whether he can properly invite these amicus briefs in a criminal matter. It at the very least, he can order a hearing on the motion to test the validity of the government’s claims. Since their motion is based primarily on new assertions of fact rather than matters of law, the judge can very easily say he needs an evidentiary hearing before he can draw any conclusions on the government’s factual assertions. |
Especially since he denied leave earlier in the case, for third parties to file amicus briefs in support of Flynn. |
Since the case is no longer adversarial, inviting amicus briefs seems like the next step. If Powell (and Shea and Barr) want a circus, give them a circus. |
