He cannot get a pardon for Georgia state crimes until 5 years after sentence completion. Which is why legislation is being proposed right now to change that.

More to the point, this Georgia case may take multiple years. So Trump is thinking he can still be President in the meantime, push for this law change, and put pressure on the Georgia board of pardons or whatever it's called.

I realize it’s crass, but that’s literally the only thing that makes her stand out in the crowded field of GOP criminals. Everyone was flipping out that she might get infected and sure as can be.

Both Arizona and Pennsylvania have had investigations underway for quite some time. There are nuances in state law that make it more appropriate to charge false electors and those who conspired with state crimes. Of course there is no double jeopardy between state and fed. Some of the charges could go federal so they can be indicted there too. Not instead. Didn’t the false electors defraud the people of the United States and obstruct our civil rights? Meadows should tread really carefully here.

Georgia is claiming jurisdiction for all that with the RICO. The charges include Eastman sending an e-mail to Giuliani about electors in Pennsylvania.

This is not an executive privilege claim. It’s federal officer removal. It is based on a statute (28 USC 1442) and requires the defendant be a federal officer “acting under color of” federal office, and have a plausible federal defense.


He is charged for participating in the phone calls and text messages to Georgia officials pressuring them to throw out the election results and declare Trump the winner and for sending them all the crazy election fraud theories with no supporting evidence or law in an attempt to justify the demand to blow up democracy.

None of that is remotely related to his official government duties. They are fraudulent campaign activities that he is supposed to be barred from doing while working in the White House.

What does that mean for us non-lawyers?
If it means that the case will be tried under Georgia law even if it's in federal court, then what's the point of moving it to federal court?

Well, Meadows actually was a federal officer at the time of the alleged activity. It's not a slam dunk, but he does have grounds.
However, not sure it would even make a difference. The Atlanta federal courthouse still pulls from the Atlanta metro.


I think it's a stretch to say that conspiring to overthrow an election was part of his official duties.

One The federal jury will be more conservative and support Trump.
Two Federal courts will not show the trial on TV. Fox would be forced to cover or heavily edited anything about the trial.

Yeah, this seems to be the next big "issue" for the right.

Hopefully, Covid has killed off more or their voters than the GOP thought.
