Exactly. What the PP does not understand is that this report is not a pleading. The Rules of Evidence do not apply. He was positing reasons for not bringing the case, and the fact that Biden’s cognitive issues would evoke sympathy from a jury is certainly one of them. It would be very difficult politically for anyone other than Kamala Harris to be selected at the convention. None of them are likely to get nominated.

Only the "little people" have to pay for this kind of alleged crime to paraphrase Leona Helmsley. Biden and Hillary Clinton were not charged. Sandy Berger was allowed to plead to misdemeanor for allegedly stealing and destroying classified documents from the National Archives to cover up alleged policy failings and allegedly lying about it too. "Mr. Biden willfully retained marked classified documents about Afghanistan and unmarked classified handwritten notes in his notebook, both of which he stored in unsecured places in his home."

"Willfully" means:
1.with the intention of causing harm; deliberately.
2. with a stubborn and determined intention to do as one wants, regardless of the consequences.

How is this not "with intent" or not proof. Hur chose the word "willfully" for a reason.

Around the same time as the relevant period, Biden proactively returned other classified documents to government authorities that he discovered in his home. The report notes this evidence supports Biden’s innocence.

his staff removed boxes from his office and put it in his garage where it sat for years. That is inly willful in the sense that someone willfully moved a box. Also there were no documents marked classified the way there are for Trump. These were mostly private handwritten notes.
