I desperately need some advice on this issue. I'll try to explain as best I can...
Our roof deck of our condo building, to me, seems really unsafe our the condo board is a bunch of total jerks. So if you walk out onto the room there is a fenced in area with chairs and a pool. This fence gate leads out to a gravel surface all the way to the edge of the building with not barrier wall, just a drop down to the group 9 floors. The gate is always left wide open. I have a two year old and this scares the crap out of me. Of course I watch him like a hawk but it only takes a second for him to bolt. When I am on the roof I out up a bike lock on the door to close it tight and remove it when we leave. The building manager and board president told me that I can't do this anymore and that the fence must remain open. The deck is open 25/7. Lots of people drink at night up there. I could see this being a major liability considering anyone can just walk up and off the roof. Are their laws requiring a wall or fence around the roof top or are residents always permitted to access these areas? Sorry if this is confusing. I hope someone can help me out here. | Contact the condo's management company. They may be more concerned about individual liability than the "total jerks" who made you remove the bike lock. |

| I would send a letter to the board/management company cc'd to as many responsible people as you can think of explaining your concerns. Anybody with a brain in their head will realize that if they get a letter like that, don't do anything, and then something bad happens, the condo assn will have liability through the roof. If you want you could point out that are concerned both as a parent and as a member of the condo assn that will ultimately bear the cost of any lawsuit. |
But have someone edit the letter before you send it. |

Honestly, a normal fence on a rooftop would look tacky. I could see if the building had built a ledge into the plans for the get-go, but I don't see it as a reasonable request to have the building significantly altered after the fact with concrete pours, just for the safety of your child and/or drunks. That would be a significant assessment for the entire building involved.
If it helps, my building has iron railings moored into the concrete itself on my rooftop. They look like this but thicker

I don't understand why there even has to be a gate, never mind why it must remain unlocked. Do residents walk out ok the gravel? How wide is the gravel area between the fence and edge of roof?
The only reason I can think of is that the gate is necessary for maintenance access... But even then it could easily be kept locked. |

| Agree with PPs who suggest contacting the management company. If they don't respond, send in a post to PoPville. |
Crowd sourcing to DCUM or PoPville may satisfy the soul not resolve the problem. This is the reason a portion of the condo fee pays the management company |
It may help in that it provides publicity and the management company may feel more pressure to resolve this. It's worked in other instances of individuals being ignored by business or govt entities until the problem was aired on PoPville. |
