| Chauvin just said he's not testyfing. |
That's interesting... wouldn't it benefit him to say that he did in fact think that Floyd was OK (or whatever -- just confirming the defense's arguments)? It seems like him not testifying suggests that those "alternative narratives" aren't actually true... |
Seeing how the defense has been cross-examining the defense witnesses, I'd be scared if I were him. They did say that he and his lawyer have had numerous discussions on him testifying, practically daily. I'm sure they covered all the pros and cons. |
| ^^ That should have said Seeing how the prosecution has been cross-examining the defense witnesses, |
too risky on cross examination. nothing worthwhile enough to gain vs that risk. |
| this rebuttal of tobin feels dangerously close to flirting with a mistrial. |
| ^i never expected that would happen, wow. |
| Did the prosecution not enter the CO results into evidence because they didn't anticipate the defense blaming it on that? What was the reason for this craziness? |
|
I donāt really know, maybe they thought the numbers were so insignificant and that it didnāt merit bringing up. As was said, they was skating on a thin razorās edge.
The demeanor of Chauvinās behavior: non emotional, unmoved, uncaring, lack of empathy - will go against him during deliberations. Compare him to Kim Potter who is clearly distraught of her actions and admitted fault, they couldnāt be more different. The Prosecution proved their case. |
|
is the mistrial potential over now that the testimony is over and defense rested? or can they still push that at a later time?
it feels like tobin did exactly what the judge said not to do by referencing test results, even if a bit indirectly. |
I think itās over. ā Tobin was permitted to discuss oxygen levels in Floyd's blood. He said that given the readings they have on his oxygen saturation level, Fowler's assertion on how much carbon monoxide could have been in his blood was incorrect. "It's simply wrong," Tobin replied. He said Floyd's measured 98% oxygen saturation in his blood, which would be considered normal.ā He answered the question without citing the Carbon Monoxide lab results they had, but had not disclosed to defense until last night, that would have caused a mistrial. |
| Predictions? I say he walks. |
| Iām sticking with second degree murder. I would be shocked if he walked. |
| Heās not going to walk. |
