I doubt he walks but juries have surprised me before. I guess it’s never 100%. There could be issues on appeal, for example the 3rd degree murder situation that led to that charge being reinstated hasn’t been fully resolved by MN high courts. Theoretically if he was only convicted on 3rd degree then later the MN Supreme Court decides to hold to a stricter interpretation of the 3rd degree murder statuatory language, I guess his conviction could be vacated.

And we know that DOJ declined to grant him immunity from federal charges in conjunction with a third degree murder guilty plea, and that a grand jury was convened. So legally this isn’t the end of the road anyway.

Can he be convicted of both 3rd degree murder and manslaughter? Or would his guilty verdict just be downgraded to manslaughter automatically if the courts find 3rd degree murder should not apply?

I don’t know why they didn’t because the Defense let them know it would be brought up.

It seems like they had some idea because earlier on in the prosecution case they had MPD witnesses that mentioned the squad car is a hybrid vehicle. I don’t know why they didn’t follow it up with the medical testimony and asking the medical examiner for specific testing to exclude that cause, maybe it seemed like explaining the car was a hybrid resolved the issue.

Yes he could be convicted of both. That’s likely too. But if they found him not guilty of the manslaughter charge at this trial, then double jeopardy would apply. It probably wouldn’t be very consistent for them to find him only guilty of 3rd degree murder, but not the manslaughter charge. But juries sometimes do surprising things, they were instructed not to read outside info like controversies about the charges or anything else like that. So they are just looking at what they believe to be the elements of this case presented at trial, and doing their best to render a verdict on that information.

Early on, he had a solid chance to walk. But the prosecution brought a couple of rock solid witnesses, and the defense’s witnesses mostly underperformed. I watched voir dire, and the jurors seemed like softies. So I think they will convict on something.

The Casey Anthony case was entirely speculative. The whole “smell of death” nonsense totally killed the prosecution. I was in agreement when she was acquitted based on the trial. Do I think she did it? Yes. But I think there was enough reasonable doubt to not convict her. That’s the standard....


Here with Chauvin? There’s a video. Floyd died under his knee. There was no reason for him to be pinned like that for that long. End stop. There’s no reasonable doubt.

seems like the decision to not have the jury sequestered this weekend will lead to defense motioning for another mistrial, no? some pretty interesting developments:

-Congresswoman Maxine Waters, in Brooklyn, calling for more confrontations if its not a guilty murder charge.

-2 MN national guardsmen fired upon in a drive by shooting in Brooklyn not long after that.

-Severed pigs head left and pigs blood splattered at former home of defense use of force witness Brodd, thinking he still lived there.

Would they motion for it before jury deliberations or just hang on to that for appeals if it is a verdict they don't like? both?

Anthony walked because she was overcharged based on the evidence they had. Had they tried her for lesser charges she could have been convicted.
