If it's on a gasoline/hazmat site, he needs to remediate it himself or lower the price enormously. If it's sitting it's because he's being a greedy bellend.

It would be a better use to have the lane be clear during rush hour each morning (and before you dismiss me as a MD driver not entitled to open lanes in the city, I'm a DC resident who lives in the neighborhood).

It also would be fairer use to have the streatery taken down, unless we are going to offer it as an option to every other business. Does the owner pay the city for that space?

Rosemary's should pay the Jake's owner something to be allowed to use their outdoor space. Positive for everyone -- gets the ugly streatery out of the street, restores the through lane for commuting, gives the Jake's owner some revenue, and the bistro still has additional space.

The new streatery regulations were finally published in the DC register in May, and there was a public-comment period that ended June 2. I have no idea if the new regulations have been finalized or not, but DDOT said restaurant owners could start applying for public space permits on March 30. Based on my reading of the new regulations, which can be found at the link below under "view text," the Rosemary's streatery violates numerous provisions in the new regulations:

-- Fully enclosing a Streatery

-- Locating a streatery in a rush-hour-restricted travel lane

-- Locating a streatery on a road with a functional classification designation of Principal Arterial, as Connecticut Avenue is designated

The Washingtonian article from last October clearly states that the Rosemary's streatery is in violation of the new regulations and will have to be dismantled by July, and the restaurant owner said he would comply with the rules.
