Intent is not required to consider the law broken. Some unfortunate solider sent his parents a selfie, and in the background was a comouter screen showing some classified photo of a submarine. The guy didn't INTEND to send his folks the sub photo, but still....he lost his position and may even be facing jail time.

His lawyer is using the Clinton defense. It might work as her corruption has set a bad precedent. Comey did say more or less it doesn't mean other people wouldn't be charged for similar offenses. So in essence - if you're a privileged corrupt politican who lies, you'll get off the hook. You and I? Not so much. We've turned into a banana republic.

Because if the information was classified and was incorrectly marked (missing the classification header) whoever sent it that way is in trouble. No classification header means not classified, paragraph markings do not make it classified, at least in my experience.

Do you work with classified info? It is the CONTENT of the material, and not the marking, that makes something classified.

I really think Comey initially wanted to recommend prosecution to Lynch, and the thought all along was that she was just say no. But once the deal is the plane got out, everyone knew if Comey recommended prosecution and Lynch didn't follow through that the fix was in. I therefore think there was a rush to have the interview and pressure on Comey to let her walk. The very fact that he decided to release all this very damning information is his way of letting everyone know how really incompetent and dishonest she is. It's like he thought, OK.....I can't recommend indictment based on political pressures, but I can sure let the world know what a lying, clueless woman this nominee is. I guess it's how he sleeps at night.

I think that had he recommended prosecution, he would not have been able to discuss the case at all. When he said that no reasonable prosecutor would have recommended indictment, he was telling the truth--that no reasonable prosecutor would recommend indictment with this DOJ--especially after Lynch's tarmac meeting with WJC.

She did. This isn't the first time she has played ignorant. Remember the Whitewater papers found in the WH living quarters after 2 years.

My SO had a TS/SCI clearance with LSP and worked at an agency and she knows. And she doesn't believe Clinton and does believe she should have, at the very least, been charged and allowed to prove her innocence.

I've never had a TS clearance--but I'm pretty sure that I would know that possible drone targets are highly classified.

I imagine that these discussions by email were referencing classified information that these people already knew. If you are writing emails like this or referencing information as in a conversation, there would not be a stamp on the email--because it shouldn't be on email to begin with.

DS had clearances at extremely high levels. You do not share that information with ANYONE without clearance, and, unless there is a NEED to know, you do not share it with others who do have the clearance. Just because you have a clearance does not mean you have access to all classified information.

Of course she knew. But it was more important to her to hide her emails, and I suspect particularly those dealing with the Clinton Foundation, from public eyes via FOIA requests in order to further her politicsal ambitions. So she was willing to put national security at risk. Someone who made such a decision should be disqualified from holding public office.
