I think that had he recommended prosecution, he would not have been able to discuss the case at all.  When he said that no reasonable prosecutor would have recommended indictment, he was telling the truth--that no reasonable prosecutor would recommend indictment with this DOJ--especially after Lynch's tarmac meeting with WJC.
