Actually, intent is not a component of the laws and rules she violated. The FBI chose not to recommend indictment simply because they felt as if they could not prove intent. And, some people have been prosecute for similar or lesser crimes when intent was not evident. And, what the pp said was accurate. |

Intent is not required to consider the law broken. Some unfortunate solider sent his parents a selfie, and in the background was a comouter screen showing some classified photo of a submarine. The guy didn't INTEND to send his folks the sub photo, but still....he lost his position and may even be facing jail time. |

His lawyer is using the Clinton defense. It might work as her corruption has set a bad precedent. Comey did say more or less it doesn't mean other people wouldn't be charged for similar offenses. The link below talks about the "Clinton Defense," used by a soldier's lawyer. He was facing more than 6 years in jail, and the sentence was reduced to 12 months. Because if the information was classified and was incorrectly marked (missing the classification header) whoever sent it that way is in trouble. No classification header means not classified, paragraph markings do not make it classified, at least in my experience. |
Huh? If you're talking about Clinton, she should have known better. More than 100 emails were classified AT THE TIME (even if they weren't marked.) A discussion about drone attacks is OK for an unsecured server? How did someone this incompetent get to be SoS?
