There is a difference between SN and requiring remedial education. This kid may or may not have been SN, but he was certainly in need of remedial education and based on testimony from his own teacher, his academic goal was only to pass the class which required his full commitment. At that academic level he should have been in a different learning environment that could meet him where he is and better cater to his academic needs. |
The sentence was 40 years, with 22 years suspended -- not 18 years. That took into account non-public information, such as prior juvenile convictions and other interactions with law enforcement. Mitigating factors including prior interactions with the victim, would be considered also. You don't know whether he was a "career criminal." It's possible that this child has had several opportunities already for redemption in the juvenile system. The kid wasn't convicted of homicide but attempted homicide, so that was considered. It was attempted first-degree homicide, which means the shooting was pre-meditated. This wasn't a heat of the moment matter of self-defense. If you are talking about Victor Bout when you mention "crazy Russian arms dealer," he was sentenced to 25 years not 20 years. |
