Fairfax County Double Murder

Other details - BB had prior affairs, had told another affair partner that he would leave CB for her and that "It would be so easy if [CB] was not around."

He told the AP to keep her mouth shut while on a recorded line; she said to him "I hope you are not just staying with me because you are afraid of me turning against you"

He did not ask or seem interested in CB's welfare, only if JR had a pulse

Prosecutors believe JR was shot in a far corner of the bedroom and he was moved to the bed area. They also said JR's arms were in a position that would have been impossible for him to be in having been shot in the chest. They said BB and JM re-packed his backpack.

Prosecurtors still haven't fully explained how or when CB was stabbed. I said this a few pages back, but either CB was stabbed before JR got there, OR CB was expecting BB to come back for sex that morning (not sure if CB was aware that JR was part of the plan coming to the home -- perhaps or not).

Seems like CB would be making some noise if she was (a) alive when BB and JR arrived in the bedroom, and (b) when BB shot JR. So IF CB was alive when JR/BB entered the bedroom, she must have expected JR as part of the sex plan with BB, and BB must have killed her right away so that JR might have thought it was just an act, not a real killing --- until he realized it was real, and JR backed away into the corner where he was shot.

The other option is that BB stabbed CB before JR got there, and then JR and BB entered the bedroom at nearly the same time. JR realizes that CB is stabbed, and he backs away -- while BB shoots him.

More details from WashPost -- BB was learning Portuguese and CB and BB were planning to to to Brazil. CB said as much on a jail phone call to BB.

CB's parents are trying to get custody of the little girl... who will be seriously messed up for life.

Do you mean JM and BB were planning to go to brazil?

This is going to be important to a jury. For any NORMAL person, if you think your spouse has just been stabbed and is near death at a hospital, you would be FREAKING out and desperate to know how they are, if they are alive, etc. Not asking about your wife's condition is 1000% not normal in an intruder situation.

I really think you're reaching here. They could easily have set this up depending on what was agreed - i.e. BB told her he was coming home so she didn't question, told JR to wait down stairs till further direction, and on and on. The circumstances of exactly what was communicated re: how JR should enter the house have not yet been revealed. I highly doubt CB actually set this encounter up.

WashPost Article:

Brendan Banfield told police that when he entered his Herndon home with the family’s au pair one morning in February 2023, they interrupted an intruder stabbing Banfield’s wife, Christine, and that Banfield shot the man, Fairfax County prosecutors said Friday. But paramedics found their bodies moved and repositioned, the prosecutors said, with the man’s arms seemingly smeared with Christine Banfield’s blood and crossed in a position he could not have achieved after being fatally shot in the chest.

As paramedics worked to save Christine Banfield, her husband didn’t ask about her, Deputy Commonwealth’s Attorney Eric Clingan said at a bond hearing for Brendan Banfield. Instead, Brendan Banfield asked if the man, Joseph Ryan, had a pulse, because he was the one witness who could describe the series of events if he lived, Clingan said. He did not.

Prosecutors on Friday revealed a series of new details about the double homicide in a quiet residential neighborhood, and the actions that have occurred in the 19 months since. The au pair, Juliana Peres Magalhães, 24, was arrested and charged with murder in October after admitting firing one shot at Ryan, 39, of Springfield.

Chief Fairfax Circuit Court Judge Penney Azcarate ruled Thursday that she would allow cameras in the courtroom, after Court TV and other outlets requested video access. It is only the second criminal trial in Fairfax in recent years to allow cameras, though Azcarate also permitted them during the civil trial she handled involving actors Johnny Depp and Amber Heard in 2022.

Azcarate ruled Friday that Brendan Banfield, now 39, must remain in the Fairfax jail until trial, finding him both a flight risk and a danger to himself and the public. over the objections of his lawyer, John F. Carroll, who said Banfield needed to be home to take care of his daughter. He was arrested and charged with murder this month, after Fairfax police served multiple search warrants, surveilled him for months and listened to his phone calls with Magalhães from jail.

Clingan said at Banfield’s bond hearing that Banfield’s mother is bankrolling the au pair’s defense and “controlling the ability of the co-defendant to cooperate.” Clingan did not say whether Magalhães is speaking with investigators, or why prosecutors indicted Banfield almost a year after Magalhães was arrested. Ryan Campbell, Magalhães’s attorney, did not immediately return a call seeking comment.

In a recorded jail call before Banfield’s arrest, Clingan said, Magalhães told Banfield, “I hope you are not just staying with me because you are afraid of me turning against you.” Banfield allegedly told her to keep her mouth shut on the recorded phone line.

Clingan also said Fairfax police have found that Banfield had prior extramarital affairs and that he had promised one woman he would leave his wife. “He told her,” Clingan said, “‘It would be so easy if [Christine] was not around.’”

Prosecutors presented an undated photo of Magalhães practicing shooting at a gun range, and records showing her there in October and December of 2022. Banfield bought a gun from the range in December 2022, they said, even though he already had a service weapon as a criminal investigator for the IRS. The IRS said Friday that Banfield worked for the agency from January 2019 until he was fired on Sept. 3.

Banfield told investigators he left the home about 7:11 a.m. on the day of the killings and made his regular stop at McDonald’s for an Egg McMuffin and an orange juice. But he said he went back home at 7:37 a.m. after receiving a call from Magalhães about an unknown man entering the house, having taken only one bite of the McMuffin, Clingan said.

Neighbors’ Ring camera footage showed Banfield, Magalhães and Banfield’s daughter, then 5, enter the home through the back, rather than the front door, and Clingan said the girl was left in the basement while Banfield and the au pair investigated. Ryan apparently had been drawn to the house through an online website, where he met a potential partner to engage in a “rape fantasy, complete with bondage and sadomasochism,” Clingan said.

Clingan said Ryan and the partner — not discussing whether it was Christine Banfield or someone posing as her — had some online chats in which Ryan sent photos of the devices he would bring, to include belts, zip ties, and a knife to cut someone’s pajamas off. At the scene, police found a set of cleanly cut pajamas on the bedroom floor, Clingan said.

Banfield told police that he saw Ryan stabbing Christine Banfield in the bed, and shot him once with his IRS service weapon. But Clingan said experts determined that Ryan was shot in “a rear corner area of the bedroom” and struck in the head. At this point, Magalhães called 911 but hung up after eight seconds.

Clingan played a recording of the call, and said Ryan could be heard “moaning in despair” in the background, blinded but still alive. A Fairfax call-taker immediately called Magalhães back, as is protocol with all “911 hang-ups,” but no one answered. Banfield told the first responders they didn’t answer because they couldn’t find Magalhães’ phone. “This was preposterous,” Clingan said, “and he had his own phone.”

Banfield told police he instructed Magalhães to retrieve the gun he had recently purchased, and that she then fired the shot that killed Ryan. Clingan questioned why a second gun was needed when Banfield had already wounded Ryan.

Fifteen minutes later, Magalhães called 911 again, prosecutors said. Clingan suggested the delay was so that Banfield could stage the scene, including repacking Ryan’s backpack and placing the knife Ryan brought to the house on the floor between Ryan and Christine Banfield.

Police searched the home and seized Magalhães’s Brazilian passport. But Magalhães and Brendan Banfield had plane reservations to fly to Brazil last October, Clingan said, after having obtained a second Brazilian passport for her.

Magalhães’s lawyer said at an earlier hearing he had advised her to get a new passport because the police wouldn’t return her old one.

Also, Banfield was studying Portuguese and had purchased an electrical adapter for use in Brazil, Clingan said.

Magalhães was arrested before the couple could depart. Clingan introduced photos of the two cavorting in New York and elsewhere, as well as of the au pair’s clothes in Christine Banfield’s closet. He said the two discussed plans to live in Brazil on their calls after Magalhães’s arrest.

Carroll, Banfield’s lawyer, cast doubt on prosecutors’ arguments, saying “I don’t know if learning Portuguese is something that’s against the law.” Banfield’s mother lived with the family, but Christine Banfield’s parents are now seeking custody, Clingan said. Banfield’s trial is set for February.

BB and JM had BOOKED FLIGHTS to Brazil last October. That's probably why they had to take JM into custody.

This new info is wild! And none of this means that JPM has flipped.

16:47 here.

I'm saying that if CB did not know anything about JR being there, she would have been upset about a strange man being in her bedroom. So if she was not already stabbed when JR arrived (which we don't know), then she must have been expecting either BB to return, or she was expecting BB AND JR for some sex games.

They could have had them both under gun point. Would actually explain better why the AP also had a gun

BB was coaching his 6 yr old daughter's soccer team! Holy crap! Can you imagine being a parent on that team??? And he was supposedly "tutoring" and "teaching robotics"!

Don't any of these child-centric businesses/activities have any screening?

From WTOP:

The Virginia man charged in the deaths of his wife and another man inside a Fairfax County house will stay in jail until his trial in February.

Judge Penney S. Azcarate agreed with prosecutors that Brendan Banfield, 39, was a danger to himself and the public, and he might not show up for the trial in the stabbing death of his wife, Christine Banfield, and the shooting death of Joseph Ryan.

Christine Banfield and Ryan were killed inside a bedroom in the Banfields’ home on Stable Brook Way in Herndon in February 2023. Brendan Banfield was arrested earlier this month, nearly a year after the Banfields’ Brazilian au pair Juliana Peres Magalhaes, 23, was charged with shooting Ryan.

Brendan Banfield’s attorney, John Carroll, said his client needed to be free, citing “he has a 6-year-old daughter who needs him at home.” He also painted Banfield as a man just trying to carry on with life following the death of his wife, adding that he was “gainfully employed,” serving as a tutor, teaching robotics, delivering medicine for cancer treatment and coaching his daughter’s soccer team.

“Mr. Banfield has asserted his constitutional rights but otherwise has been cooperative with the numerous search warrants … there is no evidence to suggest that he would obstruct justice or anything else pursuant to” Virginia bail laws, Carroll argued in a Wednesday afternoon court filing.

Brendan Banfield is an agent for the IRS, where he has been placed on administrative leave, pending the investigation’s outcome.

What happened inside the Banfields’ house?
Prosecutors have alleged someone used Christine Banfield’s laptop to make an account on an adult fetish website, which Ryan responded to before visiting the Banfield home with the intention of having “rough sex” with her.

Prosecutors also said Brendan Banfield and Peres Magalhaes cooked up the plot involving a sex fetish website to lure Ryan to the house, and alleged the two were having an affair.

Peres Magalhaes’ defense attorney, Ryan Campbell, argued in another hearing that the evidence showed Christine Banfield established the adult website account, and also purchased tickets for Peres Magalhaes to take the couple’s then-4-year-old daughter to the National Zoo in D.C. during her alleged assignation with Ryan.

Peres Magalhaes told detectives she saw Ryan holding a knife to the throat of Christine Banfield, who was nude, inside the master bedroom. Brendan Banfield likewise told investigators that he walked in on Ryan stabbing his wife in bed, so he shot and killed him using his IRS-issued service weapon.

Virginia prosecutors contended that Ryan was shot not standing over Christine with a knife, but instead in the corner of the bedroom and was likely kneeling.

After shooting Ryan, Peres Magalhaes said Brendan Banfield told her to get a gun from a safe in the bathroom of the master bedroom. She then fired a shot at Ryan, which struck him in the chest, and “devastated his heart,” according to the medical examiner who testified at a December 2023 hearing.

Eric Clingan, with the Fairfax County Commonwealth’s Attorney’s Office, played a 911 recording in court that prosecutors say was Ryan moaning in pain. The call was made from Peres Magalhaes’ phone, but she hung up eight seconds after starting the call. Another 911 call was reportedly made from her phone some 15 minutes later.

JR was shot while he was likely kneeling.

Think about that. Why would JR be kneeling in the corner? Maybe b/c BB was holding a gun on him?

I am guessing the police concluded that JR was kneeling because of where the blood splatter from the first shot to his head was splattered on the wall.

It's quite a puzzle for the police to put together. Why is JR in the corner? Why wasn't he fighting? If BB was stabbing CB, how did he have a gun pointed to JR? I'm sure it all happened fast, but you'd think JR would run out if he could or he'd try to help CB if he thought she was being hurt.

Any theories on how all these details that we know fit into a second-by-second explanation?

Did BB stab CB before he left at 7:00 a.m.? If not, how did he stab her while JR was there and hold JR off with a gun?

Maybe it's just inaccurate writing in the WTOP article... but why is JM saying she saw JR HOLDING A KNIFE to CB's throat, and yet BB told police he walked in and saw JR ACTUALLY STABBING CB.

I thought BB supposedly came into the room BEFORE JM. So, how could JR being holding a knife to CB's throat (when JM arrives in the room) if BB is there and saw JR already stabbing CB.

I assume the AP got the gun beforehand rather than as she described. They both had guns from the getgo to direct the scene.
