Trump can wake up tomorrow morning and claim to remember he mentally declassified something four years ago. His powers of declassification are infinite and could outlive even him. If Trump dies next week, Kash Patel could come forward and proclaim that Trump had said declassified something prior to 1/21/2021. Or Trump could just leave a backdated note in his desk (of course that would presumptively make it a presidential record). |

To clarify further before people really lose the plot—when he was president he could access and use any classified document he wanted, he could even divulge the information in it to the public if he wanted to, or even post a screenshot on Twitter, but it would remain classified unless it was officially declassified. Meaning the laws about classified information would still apply. And now those laws apply to him. Because he’s not president. This isn’t that hard. |
