If they get the same treatment as Trump, it makes it essentially impossible to even conduct an investigation, much less prosecute them. They can bottle up all the evidence with a special master while they argue whether it is really classified, whether maybe it's privileged (can't just take DOJ's word for it that classified documents aren't subject to spousal privilege!), etc. If you take it seriously, the Espionage Act is a dead letter.


Do you think SCOTUS will overturn established precedent with regard to treating everyone the same or say this only applies to this case? They seem to like do that.


At least four justices would say a former president is entitled to special treatment.

Problem is that he’s not really in control. Trump lawyers will drag it out, dispute everything, and then take every adverse ruling to Cannon.

Really there is little for him to do. If he says these documents are classified it blows up trump and judge cannon’s defense.

He lacks the most basic information to make an assessment regarding classification. Is the expectation that there will be an evidentiary presentation snd mini-trial as to each document and photograph, with witnesses from the intelligence community explaining the basis for classification? And what evidence could TFC possible adduce in rebuttal? The only alternative would be to decide whether Trump had the power of transubstantiation when it came to classified documents. TFG will offer the testimony of Kash Patel to the effect that he waved his hands in the air and repeated “declassified” three times while hopping on his left foot. It’s absurd.

The Motion asks that the 100 classified documents be excluded from the Special Master review so the Government can continuing using them both for the intelligence and the criminal investigation. It's pretty straightforward, and DOJ stresses over and over again how important these documents are to national security. I did like this little dig at the end - sounds like Mr. Corcoran might need a lawyer

Yet the district court here ordered disclosure of highly sensitive material to a special master and to Plaintiff’s counsel—potentially including witnesses to relevant events—in the midst of an investigation, where no charges have been brought.

She’s not a chief judge. Most obvious reference would be to Bill Pryor, who was on the Federalist Society shortlist announced by Trump for Suoreme Court vacancies. Pryor ultimately lost out to Gorsuch for the nomination.

This has been said before, but I feel it needs to be restated. Trumo made a deal with the devil. How can one person get all these breaks? Time and time again our spirits are crushed by this criminal.

I don’t understand how they’ll be able to introduce the testimony of Patel without Trump testifying. Doesn’t that break one of the hearsay rules? Patel can testify to the truth of the matter, but the truth needs to be introduced first. If there aren’t paper records, that leaves Trump. He’d have to admit he had them, which seems like a risky legal move.
