“She was in court Thursday as defense attorneys argued she was "unlawfully seized" on the day of the murders and transported from the home to the Fairfax County Police Department without consent or legal authority.

The defense said her statements, searches and seizures of her phone and Apple Watch, along with other evidence collected should be suppressed. Prosecutors said she voluntarily went with authorities on the day of the murders, adding she was not a suspect at the time of the questioning. Rather, she was an "eye or earwitness" to a double homicide.”

Can they add charges at this point?


Yes, of course! If they now have info that she conspired to kill CB, she could be charged with that. It wouldn't be in a Niv trial, but if she has a plea deal, it could include pleading guilty in both (prosecutors would quickly charge her in CB's murder if that was part of the evidence and the deal).

Typically, JM would plead guilty, and the sentencing would be delayed until after she testifies against BB...to make sure she upholds her end of the bargain.

Thats probably why they want the phone/watch data suppressed. Proof she knew- premeditated.

That’s also just standard lawyering. Both sides want to undercut the other as much as they can. Even if she was innocent a good lawyer would make the same motions

Agree. This is the one part of the sequence of events that I can't work out. I'm thinking there is forensic evidence that has not been presented yet
