Yes. This has been my theory for awhile. He plotted it and was hoping for it either to look like the story he made up or for Juliana to take the fall. Otherwise, there was ZERO reason for Juliana to be in the house, much less fire a gun. In fact, one thing that has never made sense is that Juliana and the daughter entered the house at all. Especially the daughter.

How did he get the au pair to come back into the house at the specific time, if she didn’t know about it?

DP, good point. Unless she was never supposed to return (really did forget lunches) and he was going to do it all himself making it look like either a crime of passion or that he thought Joe was an intruder, stabbing his wife. The 911 calls and multiple guns is really what made the “story” questionable…. And those were all the au pairs doing.

Because they only have one shot to arrest him. I agree and wish he was arrested much earlier (I am a neighbor and it felt uneasy seeing him walking around the neighborhood) but I do understand why FCPD had to be really careful with this case.

Ultimately, the question should be why did it take this long for Juliana to flip? Is it because her attorney is being paid for by BB? Is she just that clueless and naive hoping they will be back together again? Only time will tell but this arrest is a step in the right direction.

BB paying for Juliana's lawyer would be a massive conflict of interest and I am not sure that would be allowed even if Juliana agreed to it. I would be interested to know who is paying though.

Her mother gave an interview (Google it) in which she stated the family was not paying for the lawyer, nor had Brazil offered assistance. He's not appointed nor a PD so who else do you think may have been paying?

No idea. Maybe the au pair agency? It would not surprise me if there was a clause in the au pair contract that obligated the agency to pay for a lawyer in a circumstance like this.

You think the agency has subrogation clause in their contract that would require the agency to pay for the au pair's lawyer in the event the au pair commits murder while working? OMFG. I am a Virginia lawyer, but you don't need to be one to understand how ludicrous your statement is. 1) murder is not a reasonable action taken in the due course of her work duties of being a nanny, and 2) most employment contracts that have clauses like this have carve outs for willful misconduct and gross negligence, and I would say killing your employer qualifies as such.

And it would not be a "conflict of interest" for Bansfield or his mother to be paying for the au pair's attorney (someone wrote that). Conflict of interest where? Under what? The Virginia bar? There are conflicts of interest in representing clients in where if the same attorney that represented the au, pair, who had been representing her for a year and had obtained privileged information from her, then turned around an also represented Banfield in a criminal and/or civli case. I think it is unethical, but I don't know what you mean.

PP here you are referring to; I have no idea and I spend no time speculating about it. I was simply responding to posts that stated it "must be" a conflict of interest for BB to be paying Julia's attorney (or at last may have been before he was arrested). People who are not lawyers think they know how the law works, and I was merely pointing out what exactly did they mean, a conflict of interest? There are no Virginia bar restrictions that present a conflict of interest in the little facts we know about this case. And conflicts of interest can be waived BTW. It could be a personal conflict of interest, but as for officials "rules", no.

I've tried to work this out too but can't quite get there because I think the AP had to be at least tangentially involved. Maybe she thought she was participating in a situation where CB would be "caught" cheating giving BB reason to divorce her, not knowing that BB was planning something much more ruthless. But things like the trip to the gun range, getting new phones just before, and the simple fact that she has held out in jail for almost a year without caving.

Exactly. Anything is possible, but it's hard for me to believe that she did not knowingly play some role in this plot considering the affair happened prior to the murders, their trips to the gun range, and Juliana getting the gun from the safe and firing a shot.

I kind of think the AP didn't actually have anything to do with it- wasn't planning on returning to the house , maybe BB stabbed CB before he left and knew that Joe was going to show up, and he planned on coming back and "catching" Joe in the house with CB and pinning it on him. But then the AP came back to the house, called BB, and messed it up- hence why the whole thing seemed so poorly thought out and patched together, because that second part wasn't supposed to happen.
I also believe it's totally possible that AP has zero moral compass- sleeping with her married boss, moving into his dead wife's room- but I don't see why she took so long to flip (if she even did flip) unless she believed her own story.

DP playing devil's advocate... someone on this site and others claims that both CB and BB has affairs. Perhaps BB convinced Juliana that they had an open marriage.
