First of all, I don't think that I will ever be accused of robbing, torturing, and murdering a family and their housekeeper and setting their home on fire. My DNA will never be found on a pizza crust at the crime scene. Secondly, I don't think that people shouldn't have defense lawyers - of course they should. That is what differentiates our judicial system from that of other countries. I just don't think criminal defense lawyers should make shit up to defend their guilty clients and fight for their release back into society to commit more crimes.


The part where you are wrong is where you state that defense lawyers shouldn't make shit up to defend their guilty clients, because their clients are innocent until proven guilty. It is the defense attorneys job to make sure that the accused get a fair trial, and to do that is to attack any and all evidence against his client. It is crucial to make sure that people accused of crimes are afforded an effective legal defense because if they do not, convictions can sometimes be overturned on the basis of incompetent counsel in an appeals courts.


I'm the "he's not an animal" PP and agree with this. Everyone has the right to fair trial. Since there's been so much information about the crime, including torturing and setting fire to a child, he's just putting out whstever information he can to make his client appear to be less of a monster. His client cannot possibly have a valid reason for committing these crimes. Our entire judicial system would fail without fair trials, including a defense attorney doing his job.

Of course. Don't be ridiculous. The PP is the one who mentioned lying. A good defense attorney will fight to keep damning evidence out and try to get a lesser sentence. I don't think anyone thinks even a top-notch lawyer is going to be able to get DDW released back into society if his DNA is at the crime scene.

If there is more than one assailant, my defense strategy would be the point the finger at the other(s). Say I was there but I didn't do it, I was coerced or threatened to be there but didn't want to. If you are the only assailant, try to disprove you weren't there. It is up to the prosecution to prove the case, then you poke the holes. Either way, it sounds like the DNA evidence is solid, so then your strategy may just be to get life in prison and not the death penalty (we don't know yet whether a federal case with that could be maid, but assuming it could be).


This. Sometimes all a criminal defense lawyer can do is try to get life in prison instead of the death penalty. Either way, the perpetrator is eliminated from society and everyone wins.

So glad they caught them. We owe the police a lot. I will make a contribution to a police charity today.

I hope they hold and charge the brother up the wazoo -- and everyone else with him.

And I wish DC had the death penalty. I am a liberal but for the worst of the worst it is the right thing. Society should not have to bear the risk of an escape. He doesn't care much about his life anyway, obviously. Even if it is rarely imposed, at least you have something to bargain with.

His prior crimes cannot come into the trials to prove the likelihood he did this one. But it can be discussed at sentencing.

All you need is one wackadoodle juror, just one, to buy any doubt the defense throughs out. And you never know.....

I was on a trial in DC a few weeks ago. It was clear as day that the defendant was guilty. The crime was witnessed by 30 some people. The evidence was a clear as glass. There was no doubt.
However, there was one juror who said that he/she would not convict anyone under any circumstances. Never, ever, ever.
After 3 days of deliberation a mistrial was called.
Massive waste of everyone's time.

All of you speculating about charges and the trial and absurd things like twinkie defenses need to hold off here. First of all, we don't know what the evidence is. Lanier has said that there are things being reported that are false and she has not commented on the evidence. Everyone is entitled to a rigorous defense and if that wasn't the case, our entire justice system would crumble. No convictions would have validity.

I'm pretty confident this guy will never walk free again. There's a lot of evidence, a lot of resources have been brought to bear here. And with multiple defendants facing such serious charges, someone will turn. A defense attorney may just try to poke holes where he can and argue that the prosecution hasn't proven its case beyond a reasonable doubt. Or he may focus all his efforts on sentencing (which won't get anywhere, I don't think). All of the home invasion mass murders people have referred to in this thread resulted in convictions. This will too.

I would add that for people with horror stories about juries, if this case goes to trial (as opposed to a plea) jury selection will be incredibly protracted and each potential juror will receive far more scrutiny than usual. And even one juror wants to hang things up, its unfortunate but it just means they do another trial, not that someone goes free.
