So Trump will have the right to view these national security documents again?

Is there a risk here that Trump, while given access to the documents:

1. Identifies who might have warned authorities about illegally keeping classified documents, and

2. gets another opportunity to view classified information and spread it to unauthorized people?

The US is already a party. DOJ represents the US government and imicutly represents ODNI as a stakeholder. In this case the National Security Division of DOJ is running the show.

Trump will grant him the clearances, the judge will approve it and DOJ will fall in line. Yeah Trump is not president and he does not have the power to do that but as long as the judge goes along with it…after this is it really a bridge too far?

We are way past law and order. Wait till November. The courts are packed with republicans judges. It is going to be ugly and shockingly open.

There is no shortage of lawyers, many of whom worked for DOJ or Congressional intelligence committees, who hold top secret clearances. Some even have facilities that comply with relevant SCIF requirements. It is particularly common for those working on issues in the specialized practice areas of nuclear energy. It’s not an issue. DOJ appoints a designated person as an officer of the court to get clearances for defense counsel under CIPA all the time in espionage cases.

I believe DNI is making their assessment under an analytical framework that assumes the classified materials were released into the public domain. They can spin off every other theory from there.

That probably would mean pulling out a lot of IC assets that we cannot replace and that may not need to be pulled out. That on its own would create national security risks because of how in the dark we might be about certain countries.
