To this point, can ODNI intervene somehow to seek clarification of the order or request reconsideration?  It seems like the most effective way to get the court to reconsider this moronic decision is if ODNI points out that it cannot carry out a critical national security risk assessment without being able to talk to DOJ about these documents and the related investigation. If I'm ODNI I'm not even thinking about darkening that courtroom with my shadow.

I believe DNI is making their assessment under an analytical framework that assumes the classified materials were released into the public domain. They can spin off every other theory from there.
