So if the FBI is currently investigating a foreign spy who somehow got access to these documents, they have to stop that investigation until a special master reviews everything that was seized? On what planet does that make any sense?

It’s a weapons grade garbage decision. It’s not going significantly hinder the investigation.

The unsealed DOJ filings evidence that Trump was in possession of FISA material. The FBI was involved in some sort of a counterintelkigence investigation that lead to it applying for a FISA warrant. But the FBI can’t investigate who may have had access to classified materials obtained pursuant to the warrant. Only ODNI can do that — apparently. A Möbius strip of f8uckery.

Why did the decision say the search warrant execution was unannounced? They called the Secret Service an hour before they arrived.

I know the exceptions for an unannounced warrant are very narrow, and and infringement of 4A rights if not followed.

Not sure what point you’re trying to make. A judge can approve a “no knock” warrant under limited circumstances. Otherwise law enforcement must “knock and anniunce” prior to obtaining entry. Neither of these strictly speaking apply here. The FBI had to jump through a hurdle of contacting USSS. Not sure if it was the FBI, USSS or MAL staff who contacted a Trump attorney.

Two takeaways from today’s tuning is (1) Cannon put a fabulous shine on the steaming turd of a legal argument advanced by Trump’s McLawyers and (2) we will have to wait and see who she appoints as a SM, what clearances will be needed (and how long that will take), the nature and scope of the tasks assigned to the SM and the timeline for completing review and resolving disagreemingscas to privilege. The SM will need to give Trump the opportunity to review the documents before the SM can entertain privilege claims. The wildcard is whether DOJ will seek leave for an emergency appeal.

Looks like Cannon will appoint Giuliani next year to review everything. They will have to negotiate his fee first.
