It has become very clear she for sure was claiming to be exclusive with BIL at the time she was seeing the other guy and if true, this is a deal breaker for BIL. I guess the question is if you believe the other guy and our impartial 3rd friend. I do. BIL isn't sure yet. I suspect the relationship will limp along awhile but he will always have doubts. BIL is a jealous guy and that won't work out long term.

She could, but she told both of them they were exclusive. Lying is the issue here. And having unprotected sex with at least one of them while having sex with the other, and not telling them they weren't the only one. Although dude is an idiot for not wrapping it up, letting someone believe you're exclusive while having unprotected sex is pretty bad. Her tubes are tied at least.
