My belief is that the Biden administration knew that Garland was going to issue the subpoena to Trump and the Biden team- knowing they would get caught up in this mess - just “happened” to find these documents just before Jack Smith was brought on. The OP is right, we need a better handle on classified documents. |

This is not a better or worse comparison issue. Accidents happen. There are bureaucrats who have some explaining to do on how they are going to ensure that classified documents are returned.
Sir/Ma’am President/Senator/Congressperson, you checked out ABC documents and we see you have not returned them now that you no longer have a need to know. Please return them now. If you do not know where they are will we conduct a search…. Why is the process passive?? Someone should be proactively tracking these documents. Instead, it’s “oh sh!t, we didn’t know you had these documents.” |

Part of the problem is that the USA considers way too many documents to be classified. It's very challenging to secure so many. They should classify fewer, to guarantee the security of the really important docs. And what just happened with Biden seals the deal on any consequences Trump might have received for his utter crap idiocies. The general public won't be able to differentiate between the two cases. No one will go to jail or face any repercussions. |

Biden did not have authority to take the documents. Yes, his team follows procedures when the documents were found and that is good. But the fact is that classified documents were in a folder labeled Personal outside a skif and were accessible by random people. The OP is correct. There needs to be a better process for this whole thing. |

The existence of the documents in Biden’s office was disclosed to NARA and DOJ in November. It was recently disclosed publicly because someone leaked it to the press, so the news was going to break anyway. Can you really not imagine when people with all good intentions might not want public disclosure of misplaced classified documents? The only reason the investigation of Trump became public knowledge is because Trump tweeted about it. Otherwise we still might not know about the subpoena and warrant for Mar-a-Lago, or that Trump is being criminally investigated for his handling of the documents. |
You don’t know that Biden took them or knew they were in his office. If someone else packed them up in boxes with other papers and then put them in a locked closet, Biden may not have been aware of them. |
