In it, Reffitt allegedly said he helped lead the charge on the Capitol with a .40-caliber pistol at his side, at one point telling a U.S. Capitol Police officer who was firing nonlethal rounds at him, “Sorry, darling. You better get a bigger damn gun.”

No, the gun wasn't confiscated on Jan 6, because, like the vast majority of the insurrectionists, Reffitt wasn't arrested on Jan. 6.

So they plan to prove he was carrying a gun on him on Jan 6th because of words. OK then
