I've been haunted by this story since I heard about it. Much like you all, I have 3 boys and they enjoy thrill rides and water parks. Unfortunately, I do believe the PP has the statute correct when reading that ECONOMIC damages can reach up to 1M; however, NONECONMIC damages are capped at $350. A 10 year old child doesn't result in economic damages, as sad as that sounds. As much as these poor people don't want or care about the money, they won't be able to obliterate the Schlitterbahn corp. at $300k; which, I would think, would be part of their plan.

NP here. Not irrational. If you are a Republican legislator and you vote for deregulation, this is a foreseeable, direct consequence. No one should have to die, but perhaps this Republican will grow a conscience because of it. Save your righteous indignation for the folks that allow corporations to flout safety in the name of profits. And if you don't think cars, trains and airplanes are safer because of regulation--why aren't you driving a vintage Pinto or Corvair? |

It's not this poster's job to fix the world because she endured a horrific tragedy. Get off your high horse and help some people yourself. |
It appears that punitives can go up to $5 million. That wouldn't do it either. I thought that Disney faced an existential crisis with legal exposure resulting from that horrific alligator attack. It appears, though, that the parents elected not to sue. It's their choice, obviously. Both situations cry out for punishment and governments HAVE to step in. |

Sorry, PP, but the "Wouldn't it bother you if there are children still here..." was a very callous statement. PP may not have intended it that way, but as someone who has lost a child myself, I bristled at this too. |

^^^ You have no idea the darkness that accompanies losing a child. You don't want to think about the other children who are still here when *your* child is not. Maybe, eventually, slowly you can come to that place. But maybe not. |
Prayer? Pray if you like but enact reasonable laws and impose shattering fines for non-compliance. |
