In the 23 years since its approval, the drug has been widely proved to be safe, and this is the first time a court has ordered the FDA to remove a drug from the market.

Mifepristone is used to induce abortions as well as for other medical applications. Although the Supreme Court argued last year in Dobbs v. Jackson Women’s Health, which overturned the 1973 Roe v. Wade decision legalizing abortion, that getting rid of Roe would enable states to make their own decisions about abortion, Kacsmaryk’s decision would remove mifepristone across the entire United States. Mifepristone accounts for about 53% of medically induced abortions.

Vice President Kamala Harris, who has led the administration's policy on reproductive rights, noted that Kacsmaryk’s decision does not simply impact abortion: it opens the door to politicizing chemotherapy drugs, asthma medicine, blood pressure pills, insulin, and so on.

Kacsmaryk also said that mailing mifepristone across state lines is illegal based on the Comstock Act, which Congress passed in 1873, making it illegal to send contraceptive materials through the mail. He went further than that, though, going far beyond the Dobbs decision to embrace the concept that a fertilized egg is an “unborn human” from the time of conception.

He stayed the ruling for a week to give the government time to respond.

President Joe Biden vowed to fight the ruling. He noted that the Department of Justice has already filed an appeal and will seek an immediate stay. “But let’s be clear,” he wrote, “the only way to stop those who are committed to taking away women’s rights and freedoms in every state is to elect a Congress who will pass a law restoring Roe versus Wade. Vice President Harris and I will continue to lead the fight to protect a woman’s right to an abortion, and to make her own decisions about her own health. That is our commitment.”

Less than an hour after Kacsmaryk’s ruling, federal judge Thomas O. Rice in Washington state issued an injunction prohibiting the FDA from pulling mifepristone from the market

Good catch - PP corrected that with info on differences between the two different forms of preventing early pregnancies to continue.

Unbelievable that this Christian Taliban judge is using a 150 year old law to prevent the abortion pill from even being mailed between states.

The extremist unborn human nonsense is being used to justify a decision that could interfere with many types of life saving medication for existing human life.

Yes true. The extremists are also targeting Plan B so that may be next if this Texan judge’s ban is upheld by appeals court/ SC.

The Food and Drug Administration's labeling warns that the product may "prevent a fertilized egg from attaching to the womb" — a statement that scientists and medical professionals say is not backed by scientific evidence but was included on the label in order to get Plan B's over-the-counter status approved. Many anti-abortion activists argue that any interference with an egg is considered an abortion; medical professionals say otherwise. 

Following the Supreme Court's decision, Justice Clarence Thomas suggested that the court revisit its past ruling on contraception. Confusion around the language on the label could mean trouble for the brand and its consumers.

Spare us your sanctimonious judgment against women who need abortions - the overwhelming majority of which are performed during first trimesters.

I do hope that you are as fervent about protecting life in other ways - lobbying for safe gun controls, eliminating the death penalty, advocating for universal health care and social safety nets for all these babies you wish forced into existence even though their mothers cannot care properly for them. Hope you help out at homeless shelters and support decent mental health care.

Having human DNA doesn't make something a human being.

Nevertheless, unless you're mandating that parents are forced by law to give their organs/blood/marrow to their kids (no exceptions), forcing a woman to carry a fetus to term isn't justifiable. Especially when there are so many beings on this earth that lack support and resources.

If you think this is the answer, you think abortion bans are about life and embryos / fetuses. Abortion bans are about controlling women - full stop. Keep the poor, poor. Keep women out of the workforce. Punish women for sexual activity and do nothing about the men. It’s an easy way to squash multiple threats to the white male patriarchy.

Human DNA is specific to humans alone. An unborn babu has human DNA. An unborn baby is alive. Are you seriously trying to argue an unborn baby is not a human?

Medical textbooks and scientific reference works consistently agree that human life begins at conception.

Any civilized society restricts the individual’s freedom to choose whenever that choice would harm an innocent person.

Personhood is properly defined by membership in the human species, not by stage of development within that species.

Personhood is not a matter of size, skill, or degree of intelligence.

Once we grant that the unborn are human beings, it should settle the question of their right to live. The right to live doesn’t increase with age and size; otherwise toddlers and adolescents have less right to live than adults.

The comparison between a baby’s rights and a mother’s rights is unequal. What is at stake in abortion is the mother’s lifestyle, as opposed to the baby’s life.

It is reasonable for society to expect an adult to live temporarily with an inconvenience if the only alternative is killing a child.

Translation: any women who seeks an abortion is slut who sleeps around, dose drugs, drinks & is a degenerate.

That couldn’t be farther from the truth.
