PP has the better retort, but just for clarity’s sake I’ll add that (a) the age of consent is usually less than 18 and (b) there’s often a “Romeo And Juliet” exception that applies (to consensual sex) between similarly-aged people even when one party is below the statutorily-defined age of consent. Media says Swetnick is 55 and Kavanaugh is 53. Two year difference would be encompassed by such a provision.

Don't be disingenuous. It goes to a pattern of behavior. And she mentioned witnesses. This is not back in the distant mists of time. If she produces the witnesses, it adds to the growing pile of evidence that suggests he has a problem with drinking and inappropriate advances.
