He should have kept his head down until he got his citizenship.

I don’t agree with what has been done to him, but the reality is that as a noncitizen, and all the likelihood Trump was going to win, the writing was on the wall.

Now he will have to wait until common sense reigns again.

Jesse Furman from the Southern District of New York doesn't have jurisdiction to hear a habeas petition of someone being held in Louisiana.

The filing was made when he was still in the NJ area. He was kidnapped by the government and shipped off to a GOP friendly circuit court jurisdiction.

After two years you have to file to get conditions lifted and a permanent green card. To do that the couple still have to go to interview and show they have a real marriage. You see people stressing out over the smallest things at this point to ace this interview. No immigration officer is going to lift conditions on his conditional green card.

That is for a marriage after arriving on a fiance visa I think.

Nope - that is for all GC marriages. They do it to make sure it's not a sham marriage. When you go for the interview to remove the conditions, they ask a ton of questions and you have to provide a lot of documentation showing you live together. So you'd better have a joint lease or mortgage, bank accounts, utilities, etc. They're very good at knowing who is lying.

That’s right. This is what probably happened him. He married an American citizen, was already in the country and so didn’t have to apply for k1 visa. So he sent off paperwork for the conditional green card and there isn’t an interview or anything. He just gets the green card back. When two years is up he has to refile and come in for the interview and that’s when the real scrutiny begins.

I agree that it appears he is being unlawfully detained at the moment. Does not mean he didn't commit crimes back then. He just wasn't charged with them. I can believe that he needs to leave the US and also believe is not being treated properly at the moment. Both things can be true.
